Separation and Divorce Tax Review: Our Analysis

CRA reviews are won on documentation: every figure filed should trace to a source document, and deadlines — 90 days for an objection — are unforgiving. T1 returns are due April 30, and June 15 for the self-employed — though any balance owing still accrues interest from April 30. Our separation and divorce tax review engagement is priced as a affordable flat fee, so the cost is known before the work starts.

Observations From Our Separation and Divorce Tax Review Files

After years of preparing separation and divorce tax review files week in and week out, a tax professional starts to see the same handful of decisions shape almost every outcome. These notes cover the ones that matter for Separation and Divorce Tax Review.

Start with the rule that decides most files: A disposition of a principal residence has to be reported and the designation made, even where the entire gain is exempt. The exemption is not lost by silence, but a late designation carries its own penalty, and the CRA now has the sale data from other sources.

That rule rarely travels alone; alongside it sits another: T1 returns are due April 30, and June 15 for the self-employed — but any balance owing is due April 30 regardless, with interest compounding daily from that date. The June deadline misleads a great many self-employed filers into paying two months late without realising it. Ask what a reviewer will want to see, and the answer sits in this rule: A T1 adjustment can reach back ten calendar years, and ReFILE handles most changes without a paper T1-ADJ. Most missed refunds are still recoverable years later. Very few taxpayers go back and look.

The common thread in these rules is that they punish assumptions and reward verification. Engaging a tax professional for separation and divorce tax review is, at bottom, a way of replacing assumptions with checked answers. Here is what to have on hand so the separation and divorce tax review work starts moving on day one.

You will see the finished work before it goes anywhere — review-before-filing is standard here, not an add-on. The fee is fixed up front, and nothing is payable until the service is done.

Separation and Divorce Tax Review Frequently Asked Questions

Direct answers to what Canadian business owners actually ask before hiring an accountant.

How much does Separation and Divorce Tax Review cost in Canada?

Separation and Divorce Tax Review starts at a fixed fee quoted before any work begins. The quote is locked at the outset and does not change mid-engagement, and you pay only after you have reviewed and approved the deliverable. Compare every plan on our transparent pricing page.

What documents do I need for Separation and Divorce Tax Review?

At minimum: prior-year returns and notices of assessment, your bank and credit-card statements for the fiscal period, payroll records if you have employees, and GST/HST filings. We send a checklist tailored to your situation after the free 15-minute call.

How long does Separation and Divorce Tax Review take?

Most engagements are completed within 3 to 5 business days once your documents are complete. Catch-up work covering multiple years takes longer, and we tell you the realistic timeline before you commit rather than after.

What happens if the CRA reviews or audits my filing?

We respond on your behalf at no extra charge for any return we prepared. Every figure we file is supported by documentation retained in your file, which is what turns a CRA review from a crisis into correspondence. See how our CRA audit representation works.

Can you handle late or missed filings?

Yes. Late filing penalties compound at 5% of the balance owing plus 1% per month, so the cost of waiting is real. We prioritise catch-up work and, where eligible, file under the CRA's Voluntary Disclosures Program to reduce penalties.

Do you work with businesses outside major cities?

Yes. We are a cloud-based practice serving every province and territory, so your location does not change the price or the service. Browse our coverage across Canada to find your city.

Which industries do you specialise in for Separation and Divorce Tax Review?

We work across construction, healthcare, e-commerce, professional services, restaurants, real estate, transportation, technology and non-profits, each with its own deduction profile and CRA scrutiny patterns. See all industries we serve.

What makes Separation and Divorce Tax Review different from filing it myself?

Software applies the rules you already know about. An experienced tax accountant finds the ones you do not: capital cost allowance timing, the small business deduction threshold, shareholder loan repayment rules, and TOSI exposure on family dividends. The fee is usually smaller than the deductions it surfaces.

What is included in Separation and Divorce Tax Review services?

Our separation and divorce tax review services include complete filing, compliance management, and strategic advice customized to Canadian tax laws.

How do I start with Separation and Divorce Tax Review services?

You can start by booking a free 15-minute call. We will review your files, provide a fixed quote, and start working immediately.

What goes wrong most often with separation and divorce tax review?

The honest starting point is this: A disposition of a principal residence has to be reported and the designation made, even where the entire gain is exempt. The exemption is not lost by silence, but a late designation carries its own penalty, and the CRA now has the sale data from other sources. Everything else we would tell you is tailoring, and tailoring requires seeing your file.

What does a tax services provider actually check during separation and divorce tax review?

Charitable donations can be carried forward for up to five years and claimed by either spouse, and the credit rate steps up above the first $200 of total gifts in a year. Small receipts claimed one year at a time sit in the low tier every time. We flag this early with every client it touches, because finding it out at filing time leaves you far fewer options than finding it out now.

Commonly Searched Separation and Divorce Tax Review Questions

The questions Canadians actually search on this topic, answered plainly. Browse every question in the Canadian tax answers directory.

Rent on your home is not deductible on a Canadian return. Two situations change that. Self-employed people, and employees who meet the work-space-in-the-home conditions, may claim the share of rent tied to the area used for work. Several provinces also run a property tax or rent based credit, applied for on the provincial schedule filed with your T1, where rent paid affects the amount. Keep receipts and your landlord's details either way.

Yes. Most people file electronically through NETFILE using CRA-certified software, which submits the return directly and confirms receipt immediately. Filing online is also what makes a fast refund possible: for 2025 returns filed in 2026 the CRA service standard is about two weeks online, against a considerably longer standard for a paper return, and registering direct deposit removes the cheque step. CRA online filing for 2025 returns opened 23 February 2026 and closes 29 January 2027.

Your marginal tax rate is the rate on your next dollar of income, not on your income as a whole. Federally for 2026 that is 14%, 20.5%, 26%, 29% or 33% depending on the bracket you have reached, and your province's rate stacks on top, so an Ontario earner in the 26% federal band adds the Ontario rate for their own band. The two sets of thresholds rarely line up, so add the two rates together.

If you owe nothing, no penalty applies, but a refund and benefit payments such as the Canada child benefit and the GST/HST credit are held up until the return is processed. If you owe, a late-filing penalty is charged and interest runs on the balance and compounds daily from the day after the due date. For the 2025 tax year the deadline was 30 April 2026. File even if you cannot pay, because the penalty is driven by filing, not payment.

A tax rebate usually means the refund on your T1, and for a 2025 return the CRA aims to issue it in about two weeks when you file online. A paper filing runs on a considerably longer standard. Rebates claimed on a separate application, such as a GST/HST rebate for a new home, take longer still because they are handled manually and are often reviewed. Filing online with direct deposit gives the shortest wait.

Federal income tax is the share of income tax that goes to the federal government, calculated on taxable income using federal brackets and then reduced by federal credits. Your province or territory levies its own income tax on the same income, which is why a paycheque outside Quebec shows one blended deduction rather than two. Employers estimate both when withholding. For your own figure, read the federal tax line on your assessed T1 rather than a rate table.

A tax is a compulsory payment to government, set by law rather than agreed by contract, used to fund public services. In Canada the main ones are income tax on what you earn, sales taxes such as GST and HST on what you buy, payroll contributions on employment income, and property tax charged by municipalities. Nothing specific is bought in return for the payment, and that is what separates a tax from a fee.

A refund grows when every slip and receipt reaches the return, so begin by downloading your slips from CRA My Account and matching them against your own records. Then check the items people miss: medical expenses, tuition and its transfer, child care, eligible moving costs, union and professional dues, charitable receipts, and unused RRSP room or capital loss carry-forwards. Prepare both spouses' returns together so transferable credits land in the right place.

A refund is paid as one amount for the return it relates to, not in instalments. With direct deposit it usually arrives about two weeks after an online return is filed. The CRA can reduce or hold it to cover tax you owe for another year, or a debt it collects for another government program. If you file several years at once, each return produces its own separate refund.

It means the price shown excludes sales tax, which is added at the till, so what you pay depends on the province. Ontario adds 13% HST; New Brunswick, Newfoundland and Labrador and Prince Edward Island add 15%; Nova Scotia adds 14%; Alberta and the territories add 5% GST only. British Columbia adds 5% GST plus 7% PST, Saskatchewan 6% PST, Manitoba 7% RST, and Quebec 9.975% QST on the pre-GST price.

Interest on a student line of credit or an ordinary bank loan cannot be claimed. The student loan interest credit applies only to interest on loans issued under the Canada Student Loans Act, the Canada Student Financial Assistance Act, a provincial or territorial student loan programme or similar legislation. A line of credit stays ineligible even where the money went to tuition, and rolling a government loan into a line of credit ends eligibility permanently.

No, not freely. Rental income and expenses follow beneficial ownership: each co-owner reports the share of the net rental result that matches their share of the property and of the money put into it. Spouses who own a property jointly and equally each report half. You cannot assign the whole amount to the lower-income spouse to save tax. Where one spouse alone owns and funded the property, that spouse reports all of the rental result.
