Transfer Pricing Services: Our Analysis

Section 216 and 217 elections can substantially reduce non-resident withholding on Canadian rents and pensions when filed on time. Our transfer pricing services engagement is priced as a pocket-friendly flat fee, so the cost is known before the work starts.

Things We've Learned Doing Transfer Pricing Services Work

Most of what goes wrong with transfer pricing services goes wrong before anyone opens the software. As a tax practitioner, that is where these notes on Transfer Pricing Services begin.

The starting point is not a strategy but a constraint: Non-residents earning Canadian rental income face 25% withholding on gross rent unless a section 216 election is filed, which taxes the net instead.

There is a second layer to this. A US LLC is a flow-through for US purposes but a corporation for Canadian purposes, and that mismatch routinely produces double taxation unless the structure is corrected. Where clients most often get hurt is not the calculation but the follow-through, and the rule reads plainly. The T1135 foreign income verification statement is required once specified foreign property exceeds $100,000 in cost. Late-filing penalties start at $25 a day to a maximum of $2,500 per year, before gross-negligence penalties.

What this means for you depends entirely on facts we have not seen yet — which is the honest answer, and the reason a tax practitioner starts every transfer pricing services engagement with questions rather than conclusions. To keep the engagement efficient, assemble these records before we begin.

We keep the commercial side simple. The fee is fixed and agreed in advance, the file is reviewed with you before filing, and you pay after the service — in that order, every time.

Case Study 1

$21,500 Of Excess Withholding Refunded On Election — Arizona Snowbird, Hamilton

A snowbird spending winters in Arizona in Hamilton, Ontario was over-withheld because invoices paid to a non-resident consultant working on site in Canada with no Regulation 105 withholding taken. Filing the election refunded $21,500.

Case Study 2

$70,000 Saved By Correcting What Prior Filings Had Missed — Inbound Assignee, Ottawa

A second opinion for an inbound transferee on assignment in Ottawa, Ontario found winters spent in the United States with the day count kept casually and no residency position documented anywhere in prior filings and recovered $70,000 a year.

Case Study 3

Notice Of Objection Allowed In Full, $113,000 Reversed — US Pension Recipient, Mississauga

A $113,000 reassessment landed at a Canadian resident receiving US pension income in Mississauga, Ontario, resting on a US LLC taxed as a corporation in Canada, producing double tax on the same income. The objection was allowed in full.

Case Study 4

Corporate Structure Rebuilt For $34,000 Of Annual Savings — Non-Resident Landlord, Calgary

The structure at a non-resident owning Canadian rental property in Calgary, Alberta no longer fitted the business, and a departure year filed as a normal resident return with no deemed disposition reported showed it. Rebuilding it saves $34,000 a year.

Case Study 5

Audit Defence Closed In 3 Weeks, $34,000 Cleared — US LLC Shareholder, Lethbridge

A shareholder of a US LLC in Lethbridge, Alberta was under review over dividends paid to a non-resident shareholder with nothing withheld, leaving the payer holding the liability. The file closed in 3 weeks with $34,000 of proposed tax cleared.

Case Study 6

Scaled To 90 Staff With $150,000 Of Working Capital Freed — US Rental Owner, Kelowna

Growth at a Canadian resident with a US rental property in Kelowna, British Columbia had outrun the back office, and foreign accounts that had passed the $100,000 T1135 threshold three years earlier broke first. Headcount reached 90 with $150,000 of cash freed.

Transfer Pricing Services Frequently Asked Questions

Direct answers to what Canadian business owners actually ask before hiring an accountant.

How much does Transfer Pricing Services cost in Canada?

Transfer Pricing Services starts at a fixed fee quoted before any work begins. The quote is locked at the outset and does not change mid-engagement, and you pay only after you have reviewed and approved the deliverable. Compare every plan on our transparent pricing page.

What documents do I need for Transfer Pricing Services?

At minimum: prior-year returns and notices of assessment, your bank and credit-card statements for the fiscal period, payroll records if you have employees, and GST/HST filings. We send a checklist tailored to your situation after the free 15-minute call.

How long does Transfer Pricing Services take?

Most engagements are completed within 3 to 5 business days once your documents are complete. Catch-up work covering multiple years takes longer, and we tell you the realistic timeline before you commit rather than after.

What happens if the CRA reviews or audits my filing?

We respond on your behalf at no extra charge for any return we prepared. Every figure we file is supported by documentation retained in your file, which is what turns a CRA review from a crisis into correspondence. See how our CRA audit representation works.

Can you handle late or missed filings?

Yes. Late filing penalties compound at 5% of the balance owing plus 1% per month, so the cost of waiting is real. We prioritise catch-up work and, where eligible, file under the CRA's Voluntary Disclosures Program to reduce penalties.

Do you work with businesses outside major cities?

Yes. We are a cloud-based practice serving every province and territory, so your location does not change the price or the service. Browse our coverage across Canada to find your city.

Which industries do you specialise in for Transfer Pricing Services?

We work across construction, healthcare, e-commerce, professional services, restaurants, real estate, transportation, technology and non-profits, each with its own deduction profile and CRA scrutiny patterns. See all industries we serve.

What makes Transfer Pricing Services different from filing it myself?

Software applies the rules you already know about. An experienced tax accountant finds the ones you do not: capital cost allowance timing, the small business deduction threshold, shareholder loan repayment rules, and TOSI exposure on family dividends. The fee is usually smaller than the deductions it surfaces.

What is included in Transfer Pricing Services?

Our transfer pricing services include complete filing, compliance management, and strategic advice customized to Canadian tax laws.

How do I start with Transfer Pricing Services?

You can start by booking a free 15-minute call. We will review your files, provide a fixed quote, and start working immediately.

What records do I need before starting transfer pricing services?

You are asking the right question, and it has a real answer. A payment to a non-resident for services performed in Canada is subject to 15 percent withholding under Regulation 105 whether or not the non-resident ends up owing Canadian tax. A waiver has to be applied for before the payment is made, and the payer that withheld nothing is the one assessed. What we add on top of that is the paperwork discipline that makes the answer stand up if anyone ever asks you to prove it.

What goes wrong most often with transfer pricing services?

Let us give you the substance first and the caveats second. Departure from Canada triggers a deemed disposition of most property at fair market value, and the resulting gain has to be reported on the final resident return. The caveat is simply that facts on your file can shift the outcome, so treat this as the baseline rather than the final word.

More Transfer Pricing Services Questions Canadians Ask

The questions Canadians actually search on this topic, answered plainly. Browse every question in the Canadian tax answers directory.

HST combines the 5% federal GST with a provincial component in five participating provinces. For 2026 the combined rates are 13% in Ontario, 15% in New Brunswick, Newfoundland and Labrador, and Prince Edward Island, and 14% in Nova Scotia since 1 April 2025. Elsewhere you charge the 5% GST alone, or GST plus a separate provincial tax. The rate follows the province of supply, not where your business sits.

A tax deduction is an amount subtracted from your income before tax is worked out, so it reduces the income being taxed rather than the tax bill directly. Its worth depends on your marginal rate: the higher the rate, the more the deduction saves. Common examples are RRSP contributions, child care costs, union dues, moving expenses and business expenses. Credits work the other way, reducing the tax calculated on that income.

Your marginal tax rate is the rate on your next dollar of income, not on your income as a whole. Federally for 2026 that is 14%, 20.5%, 26%, 29% or 33% depending on the bracket you have reached, and your province's rate stacks on top, so an Ontario earner in the 26% federal band adds the Ontario rate for their own band. The two sets of thresholds rarely line up, so add the two rates together.

Not exactly. A statement of account shows the balance as at the date it was produced, and interest compounds daily on anything still unpaid after that, while payments or reassessments since then are not reflected. Check the current balance in CRA My Account or My Business Account before paying, and pay the figure shown there. If part of the balance is disputed, pay the rest to stop interest running and raise the disputed portion separately.

Generally no. Counselling is an eligible medical expense only when the person providing it is a medical practitioner authorized to practise in your province and that profession appears on the CRA's list, a psychologist for instance. Counselling from someone outside that list, including many marriage and relationship counsellors, does not qualify. Legal fees to obtain support payments follow separate, narrow rules. Keep receipts and check the CRA's list of authorized medical practitioners for your province before claiming.

No. Federal tax starts only once taxable income exceeds your credits, and the basic personal amount alone shelters the first $16,452 in 2026, so many students, retirees on modest income and part-year workers owe nothing federally. Everyone with employment income still pays CPP and EI, and everyone pays GST or HST on purchases. Filing remains worthwhile at any income level, because benefits and credits are all calculated from the return you file.

The notice of assessment is issued once the CRA finishes assessing your return, usually about two weeks after an online filing, and up to 16 weeks for a non-resident return. The quickest way to get it is My Account, where current and prior-year notices can be viewed and downloaded. Paper copies go to the address on file unless you have chosen electronic mail only. If a notice never arrives, ask the CRA to reissue it.

You cannot make it tax-free, but you can spread or shelter it. Ask whether part of the payment is an eligible retiring allowance, which can be transferred straight to an RRSP without using contribution room; that turns on your years of service and when they fell. Otherwise use available RRSP room, or negotiate payment across two calendar years so less of it lands in your top bracket. Model both options before signing.

Zero-rated. Goods and services exported from Canada are taxable at 0%, meaning you charge the customer no tax yet still claim input tax credits on what you bought to make the sale. Exempt supplies work differently: no tax charged and no credits either. The distinction drives cash flow, since a mainly export business often files for refunds rather than remittances. Keep evidence that the goods left Canada or that the customer is non-resident.

Yes. Diapers are taxable rather than zero-rated groceries, so the federal 5% GST applies across Canada. Ontario runs a point-of-sale rebate that takes the provincial part of the HST off children's diapers, so an Ontario till charges 5% instead of 13%. Provinces with their own sales tax apply their own exemption lists, which differ from one another. The temporary federal break that covered diapers over the 2024 to 2025 holiday period has ended.

Workers' compensation benefits are not taxed. The provincial board issues a slip, you report the amount on your return, and an offsetting deduction takes it out of taxable income. It still counts in net income, so it can reduce income-tested credits and benefits. Wage-loss payments from a private disability plan your employer paid for are different and are employment income. An employer top-up of board payments is also taxable and appears on your T4.

Compare the tax withheld shown on your T4 slips with the tax your T1 return actually calculates. A large refund means too much was withheld; a balance owing means too little. Withholding follows the credit declaration your employer holds on file, so it can be wrong if you have two jobs, changed jobs mid-year, or never claimed credits such as tuition or support amounts. Filing the T1 settles the difference either way.
