US Form 1040-NR Filing: Our Analysis

The T1135 foreign income verification statement applies once specified foreign property passes $100,000 in cost — late-filing penalties start at $25 a day. Our us form 1040-nr filing engagement is priced as a budget-friendly flat fee, so the cost is known before the work starts.

Practitioner’s Notes on US Form 1040-NR Filing

If you handle US Form 1040-NR Filing once a year, everything looks equally important. Handle it weekly, as a tax professional does, and a clear hierarchy emerges; these notes follow that hierarchy.

There is no way around the opening fact, so it may as well come first. The T1135 foreign income verification statement is required once specified foreign property exceeds $100,000 in cost. Late-filing penalties start at $25 a day to a maximum of $2,500 per year, before gross-negligence penalties.

It would be simpler if the story ended there, but a second rule enters almost immediately. A CCPC files its T2 within six months of year-end, with the balance due two months after (three where the small business deduction is claimed). The 9% federal small business rate applies to the first $500,000 of active business income. The filing and payment deadlines differ, and interest runs from the payment date. Filing on time while paying late still costs money. Ask what a reviewer will want to see, and the answer sits in this rule: The rate charged follows the customer's province, not the seller's: 13% into Ontario, 15% into New Brunswick, Newfoundland and Labrador and PEI, 14% into Nova Scotia (since 1 April 2025), 5% plus provincial tax elsewhere. A seller charging its own province's rate nationally is under-collecting on some sales and over-collecting on others, and owes the difference on the under-collected ones.

You do not need to hold all of this in your head. You need someone who does — and an accounting firm handling us form 1040-nr filing week after week keeps these rules current so you do not have to. The smoothest files are the ones where the client arrives with these records already assembled.

Our terms are the same for every engagement: a fixed fee agreed before work begins, a full review with you before filing, and payment only after the service is complete.

US Form 1040-NR Filing Tax & Accounting Case Studies

See how our expert US Form 1040-NR Filing tax and accounting services have helped Canadian businesses save money and stay compliant.

Case Study 1

$215,000 Sheltered By The Lifetime Capital Gains Exemption — US-Facing Canadian Corporation, Surrey

A Canadian corporation with US customers in Surrey, British Columbia was preparing to sell. However, no valuation on file to support the price the parties had agreed disqualified the shares. Purification sheltered $215,000 under the exemption.

A Canadian corporation with US customers in Surrey, British Columbia had an offer on the table and 30 months to close. The shares did not qualify for the capital gains exemption. No valuation on file to support the price the parties had agreed was part of the reason. We purified the corporation so the shares met the qualifying tests. We reconstructed the day count on both sides of the border and documented the residency and treaty position before either revenue authority asked. All of it was done well ahead of the closing date. The sale closed on schedule with $215,000 sheltered by the lifetime capital gains exemption across the shareholders.

Case Study 2

Collections Halted And $133,000 Cut From A 4-Year Backlog — Canadian on US Payroll, Winnipeg

Collections had begun against a Canadian with a US employer in Winnipeg, Manitoba over 4 years of unfiled returns. Bringing them current cut $133,000 from the balance.

By the time a Canadian with a US employer in Winnipeg, Manitoba called, 4 years were outstanding. The CRA had assessed on estimates. Underneath it sat winters spent in the United States with the day count kept casually and no residency position documented anywhere. We reconstructed the records year by year. We restructured the US holding so the Canadian and US characterisations aligned, ending the double taxation going forward. Each filing replaced an arbitrary assessment with a real one. The account is current. Filing on real numbers rather than CRA estimates reduced the balance by $133,000, and a relief application addressed part of the accumulated interest.

Case Study 3

Reorganisation Completed Tax-Deferred, $63,000 Saved Each Year — Florida Property Owner, Edmonton

A family with a Florida vacation property in Edmonton, Alberta had outgrown its structure. The visible cost was foreign accounts that had passed the $100,000 T1135 threshold three years earlier. The reorganisation completed tax-deferred and saves $63,000 a year.

A family with a Florida vacation property in Edmonton, Alberta had outgrown the structure it started with. Foreign accounts that had passed the $100,000 T1135 threshold three years earlier was the immediate problem. The longer-term one was that the structure blocked the next step. We mapped the current structure and modelled the target. Then we registered the payer for a non-resident withholding account, remitted the Regulation 105 amounts due, and applied for waivers covering the rest of the contract. The tax-deferred elections were filed on time and the supporting valuations documented. The reorganisation completed without triggering tax, and the new structure saves approximately $63,000 a year while removing the exposure the old one carried.

Case Study 4

Desk-Review Assessment Of $91,000 Vacated — Arizona Snowbird, Vancouver

A desk review assessed a snowbird spending winters in Arizona in Vancouver, British Columbia $91,000. The dispute was over a US LLC taxed as a corporation in Canada, producing double tax on the same income. Producing the records vacated the assessment.

A snowbird spending winters in Arizona in Vancouver, British Columbia was carrying $91,000 of penalties and interest. The charges arose from a US LLC taxed as a corporation in Canada, producing double tax on the same income. Much of that amount accumulated during a period the CRA itself had delayed. We aligned the Canadian and US reporting of the same income so the foreign tax credit claim carried support on both returns. We framed the relief application on the specific grounds the CRA guidelines recognise rather than on general hardship. The assessment was vacated. $91,000 came off the account, and the documentation now on file makes the same position straightforward to defend next time.

Case Study 5

Filed On Time From A Standing Start, $40,000 Penalty Avoided — Inbound Assignee, Toronto

An inbound transferee on assignment in Toronto, Ontario was 7 weeks from a deadline. The file also carried 25% withholding on gross Canadian rent where a section 216 election would have taxed only the net. Filing complete and on time avoided roughly $40,000 in penalties.

An inbound transferee on assignment in Toronto, Ontario came to us 7 weeks before its filing deadline. The file came with 25% withholding on gross Canadian rent where a section 216 election would have taxed only the net. A late filing would have triggered a penalty of roughly $40,000 before interest. We worked backwards from the deadline. We filed the section 216 election with the supporting rental statements and recovered the excess withholding as a refund. We prioritised the items that actually gated the filing and deferred everything that did not. The return was filed on time and complete. The $40,000 penalty never arose, and the compliance calendar we set means the next deadline is scheduled rather than discovered.

Case Study 6

33 Months Reconciled And $7,700 Of Input Tax Recovered — US Pension Recipient, Guelph

33 months of records at a Canadian resident receiving US pension income in Guelph, Ontario had never been reconciled. That left a departure year filed as a normal resident return with no deemed disposition reported. Rebuilding recovered $7,700.

Nothing reconciled at a Canadian resident receiving US pension income in Guelph, Ontario. Every filing started with 33 months of cleanup. The file was carrying a departure year filed as a normal resident return with no deemed disposition reported. We rebuilt from source rather than correcting on top of the existing file. We applied the treaty rate to the dividend withholding, filed the NR4 return, and remitted the shortfall before the CRA assessed the payer for it. Then we set the routine that keeps it clean. 33 months reconciled to the bank. The close now takes 5 days, and $7,700 of previously unclaimable input tax was recovered in the process.

Your US Form 1040-NR Filing Questions, Answered

Direct answers to what Canadian business owners actually ask before hiring an accountant.

How much does US Form 1040-NR Filing cost in Canada?

US Form 1040-NR Filing starts at a fixed fee quoted before any work begins. The quote is locked at the outset and does not change mid-engagement, and you pay only after you have reviewed and approved the deliverable. Compare every plan on our transparent pricing page.

What documents do I need for US Form 1040-NR Filing?

At minimum: prior-year returns and notices of assessment, your bank and credit-card statements for the fiscal period, payroll records if you have employees, and GST/HST filings. We send a checklist tailored to your situation after the free 15-minute call.

How long does US Form 1040-NR Filing take?

Most engagements are completed within 3 to 5 business days once your documents are complete. Catch-up work covering multiple years takes longer, and we tell you the realistic timeline before you commit rather than after.

What happens if the CRA reviews or audits my filing?

We respond on your behalf at no extra charge for any return we prepared. Every figure we file is supported by documentation retained in your file, which is what turns a CRA review from a crisis into correspondence. See how our CRA audit representation works.

Can you handle late or missed filings?

Yes. Late filing penalties compound at 5% of the balance owing plus 1% per month, so the cost of waiting is real. We prioritise catch-up work and, where eligible, file under the CRA's Voluntary Disclosures Program to reduce penalties.

Do you work with businesses outside major cities?

Yes. We serve clients in every province and territory at the same fixed fees, so your location does not change the price or the service. Browse our coverage across Canada to find your city.

Which industries do you specialise in for US Form 1040-NR Filing?

We work across construction, healthcare, e-commerce, professional services, restaurants, real estate, transportation, technology and non-profits, each with its own deduction profile and CRA scrutiny patterns. See all industries we serve.

What makes US Form 1040-NR Filing different from filing it myself?

Software applies the rules you already know about. An experienced tax accountant finds the ones you do not: capital cost allowance timing, the small business deduction threshold, shareholder loan repayment rules, and TOSI exposure on family dividends. The fee is usually smaller than the deductions it surfaces.

What is included in US Form 1040-NR Filing services?

Our us form 1040-nr filing services include complete filing, compliance management, and strategic advice customized to Canadian tax laws.

How do I start with US Form 1040-NR Filing services?

You can start by booking a free 15-minute call. We will review your files, provide a fixed quote, and start working immediately.

How is your approach to us form 1040-nr filing different from doing it through software?

Our answer starts where the legislation starts. Part XIII withholding of 25 percent applies to dividends, rents, royalties and certain interest paid to non-residents. It is reduced only by the rate the applicable treaty allows. The Canadian payer is liable for tax it failed to withhold, and the amounts are reported on an NR4 information return. From there it is a matter of applying it to your year — and that application, not the rule itself, is where an accountant earns the fee.

What records should I gather before starting us form 1040-nr filing?

You are asking the right question, and it has a real answer. The rate charged follows the customer's province, not the seller's: 13% into Ontario, 15% into New Brunswick, Newfoundland and Labrador and PEI, 14% into Nova Scotia (since 1 April 2025), 5% plus provincial tax elsewhere. A seller charging its own province's rate nationally is under-collecting on some sales and over-collecting on others, and owes the difference on the under-collected ones. What we add on top of that is the paperwork discipline that makes the answer stand up if anyone ever asks you to prove it.

Commonly Searched US Form 1040-NR Filing Questions

The questions Canadians actually search on this topic, answered plainly. Browse every question in the Canadian tax answers directory.

For the 2025 tax year the filing and payment deadline is 30 April 2026. If you or your spouse carried on a business, the return itself is due 15 June 2026, but any balance owing is still due 30 April 2026. Interest runs on unpaid amounts after the payment deadline, and a late-filed return with a balance owing also attracts a late-filing penalty. Filing on time keeps benefit and credit payments flowing.

If you owe nothing, no penalty applies, but a refund and benefit payments such as the Canada child benefit and the GST/HST credit are held up until the return is processed. If you owe, a late-filing penalty is charged and interest runs on the balance and compounds daily from the day after the due date. For the 2025 tax year the deadline was 30 April 2026. File even if you cannot pay, because the penalty is driven by filing, not payment.

Multiply the pre-tax price by the rate that applies where the sale happens. In Ontario that is 13% HST for 2026; in Alberta 5% GST; in British Columbia 5% GST plus 7% PST, each applied to the same base. Quebec is the exception, where 9.975% QST is charged on the pre-GST price, giving 14.975% combined. To back the tax out of a tax-included price, divide by one plus the rate.

Zero-rated sales are taxable supplies that carry GST/HST at 0%. Basic groceries, prescription drugs, most medical devices, agricultural products and many exports are the common examples. The difference from exempt sales matters: on zero-rated sales you charge no tax but can still claim input tax credits on the GST/HST you paid on related costs, and those sales count toward the $30,000 small-supplier threshold for 2026. Exempt sales give you no input tax credits.

No, earning more still leaves you better off. Canada uses graduated rates, so a higher bracket applies only to the income above that threshold, not to everything you earn. Federal rates for 2026 begin at 14% and rise through 20.5%, 26% and 29% to 33%, with provincial rates on top. Extra income never leaves you with less after tax. What can shrink as income rises are income-tested benefits and credits, so check those first.

Yes. Rent from a room in your home is taxable and is reported as rental income on your T1. You may deduct a reasonable share of expenses such as utilities, insurance, mortgage interest, property tax and repairs, prorated by the space rented and the part of the year it was rented. Claiming capital cost allowance on the building can put part of your principal residence exemption at risk, so most homeowners do not. Keep receipts six years.

Zero-rated. Goods and services exported from Canada are taxable at 0%, meaning you charge the customer no tax yet still claim input tax credits on what you bought to make the sale. Exempt supplies work differently: no tax charged and no credits either. The distinction drives cash flow, since a mainly export business often files for refunds rather than remittances. Keep evidence that the goods left Canada or that the customer is non-resident.

The balance begins accruing compound daily interest from the payment due date, and filing late adds a separate late-filing penalty on top of it. If nothing is paid the file moves to collections, where the CRA can keep refunds and benefit payments, garnish wages or a bank account, and register a lien against property. Filing on time and agreeing a payment arrangement, even a partial one, prevents most of that. Interest runs until the balance reaches zero.

Rent for your own home is generally not deductible federally, so there is no line for it. Three situations differ. Rent on space used to earn self-employment income goes in the business-use-of-home section of your T2125. Employees with a signed employer certification may claim a portion of rent for a work space. And Ontario, Manitoba and Quebec run provincial credits where rent paid feeds a benefit calculation on the provincial schedule. Keep receipts and your landlord's details.

A non-refundable credit reduces the tax you owe but cannot create or increase a refund by itself. Where the credit exceeds the tax payable, the unused part is lost, though certain credits can be transferred to a spouse or carried forward to a later year instead. The basic personal amount, tuition, medical expenses and donations all work this way. Refundable credits differ: they are paid out even when no tax is owing.

You cannot appeal the tax rate, but you can challenge the assessed value the tax is calculated on. Each province has an assessment authority that issues a notice of assessed value, and a request for reconsideration or an appeal must be filed with it by the deadline printed on that notice. Support the claim with recent selling prices of comparable properties and evidence of anything that reduces value. A successful reduction adjusts the tax for the years in question.

Non-resident income tax is Canadian tax on Canadian-source income earned by someone who is not a resident of Canada for tax purposes. Investment income, rents, pensions and some royalties are normally taxed by withholding at source, with the payer remitting to the CRA. Employment income, business income and gains on Canadian real property are instead reported on a Canadian return. A tax treaty may reduce a withholding rate or remove the Canadian tax altogether.
