Transfer Pricing Audit Defence: Our Analysis

CRA reviews are won on documentation: every figure filed should trace to a source document, and deadlines — 90 days for an objection — are unforgiving. Section 216 and 217 elections can substantially reduce non-resident withholding on Canadian rents and pensions when filed on time. Because the fee is fixed and cheap, the economics stay predictable whether your file is simple or messy.

Field Notes: Transfer Pricing Audit Defence

Transfer Pricing Audit Defence can look routine from the outside. Sit on the practitioner's side of the desk for a while and you learn which parts genuinely are routine — and which parts reward a tax consultant's full attention.

First, the rule that sorts straightforward files from complicated ones: Taxpayer relief applications can cancel penalties and interest arising from CRA delay, serious illness or a natural disaster. The CRA is limited to the ten prior calendar years.

The second point is quieter but costs more when missed. The normal reassessment period runs three years from the original notice of assessment for an individual or a CCPC and four years for other corporations. A waiver signed at an auditor’s request removes that limit for the issue it describes. It stays open until it is revoked. And on timing: Once the CRA confirms an assessment or reassesses following an objection, the next step is an appeal to the Tax Court of Canada within 90 days. An extension has to be applied for rather than assumed, and the merits of the position do not extend the deadline.

Think of these rules as the fixed terrain; your circumstances decide the route through it. Mapping that route is the work a tax consultant takes off your plate for transfer pricing audit defence. Every transfer pricing audit defence file rests on documentation, so start by collecting.

No surprises is the operating principle: the fee is agreed and fixed before we start, you review everything before it is filed, and payment comes after the work, not before.

Case Study 1

$78,000 In Credits Claimed That Prior Filings Had Missed — Taxpayer Relief Applicant, Mississauga

5 years of filings at a taxpayer applying for relief from penalties and interest in Mississauga, Ontario had never claimed the incentives the work qualified for. The review recovered $78,000.

A taxpayer applying for relief from penalties and interest in Mississauga, Ontario had been filing for 5 years. In that time, the incentives its activity qualified for were never claimed. Behind that sat a waiver signed at the counter that kept an otherwise closed year open with no end date. We tested each activity against the eligibility criteria rather than the description on the invoice. Then we brought every outstanding return current, then negotiated a payment arrangement that stopped the collections action. $78,000 in credits claimed, with the open prior years adjusted as well. The claim passed review without adjustment.

Case Study 2

$79,000 Proposed Adjustment Withdrawn In Full — Late-Objection Taxpayer, Brampton

A taxpayer whose objection window has closed in Brampton, Ontario faced a $79,000 proposed reassessment. It came after an audit conducted over the phone, with nothing on file showing what had been provided or when. We rebuilt the documentation and the adjustment was withdrawn in full.

A taxpayer whose objection window has closed in Brampton, Ontario received a proposal letter opening a review of transfer pricing audit defence. The CRA had identified an audit conducted over the phone, with nothing on file showing what had been provided or when. It proposed an adjustment of $79,000, with 30 days to respond. We treated the response as an evidence exercise rather than an argument. We assembled the contemporaneous records, filed a structured response to each proposed adjustment with the supporting documents indexed, and had the proposal withdrawn. We then indexed every supporting document against the specific line the auditor had questioned. The proposed adjustment was withdrawn in full — all $79,000 of it. The file closed in 7 weeks with no change to the assessed amounts and no penalty.

Case Study 3

Scaled To 20 Staff With $113,000 Of Working Capital Freed — Taxpayer Facing Collections, Lethbridge

Growth at a taxpayer with frozen bank accounts in Lethbridge, Alberta had outrun the back office. A director liability assessment for a corporation that had already stopped operating broke first. Headcount reached 20 with $113,000 of cash freed.

A taxpayer with frozen bank accounts in Lethbridge, Alberta was growing fast, with headcount reaching 20 in eighteen months. The back office had not kept up. A director liability assessment for a corporation that had already stopped operating was the first thing to break. We requested the auditor’s working papers and report to see how the assessment had been built before answering any of it. We built the compliance calendar for the size the business was becoming rather than the size it had been. The business reached 20 staff with no missed remittance and no late filing. $113,000 of working capital was freed in the process.

Case Study 4

Remuneration Review Saved $41,000 Across Corporate And Personal Returns — Director Facing Assessment, Halifax

A remuneration review at a business owner with a director liability assessment in Halifax, Nova Scotia saved $41,000 across the corporate and personal returns. It found a proposal letter with a 30-day response window and no supporting records assembled.

Nothing was wrong at a business owner with a director liability assessment in Halifax, Nova Scotia. The filings were on time and accurate. What they were not was planned. A proposal letter with a 30-day response window and no supporting records assembled had never been reviewed. We filed the Tax Court appeal inside the window and resolved the remaining adjustments before a hearing date was needed. We ran the numbers across both the corporate and personal returns, so the saving was real rather than deferred into someone else's hands. $41,000 came off the combined corporate and personal tax bill, and the structure holds for future years without further work.

Case Study 5

Remittance Schedule Corrected, $144,000 Refunded — Contractor Facing Reassessment, Moncton

Remittances at a contractor facing a proposed reassessment in Moncton, New Brunswick were chronically late. It came down to a waiver signed at the counter that kept an otherwise closed year open with no end date. Fixing the schedule refunded $144,000.

Remittances at a contractor facing a proposed reassessment in Moncton, New Brunswick were consistently late by a few days. That was enough to trigger penalties every quarter. Behind it sat a waiver signed at the counter that kept an otherwise closed year open with no end date. We kept the waiver narrowed to the issue actually under review and let the remaining years close on the normal reassessment period. Then we moved the remittance dates into a scheduled process rather than a monthly decision. Penalties stopped from the following remittance onwards, and $144,000 of overpaid instalments was refunded.

Case Study 6

Month-End Close Cut From 11 Weeks To 4 Days — Assessed Shareholder, Ottawa

Closing the books at a shareholder assessed on a taxable benefit in Ottawa, Ontario took 11 weeks. The cause was a net-worth assessment built on unexplained deposits that were actually loan proceeds. It now takes 4 days.

The accounting file at a shareholder assessed on a taxable benefit in Ottawa, Ontario had a weak foundation. It was built on a net-worth assessment built on unexplained deposits that were actually loan proceeds. The year-end had taken 11 weeks each of the last three years. We answered each query in writing with an indexed document package, so the file showed exactly what the auditor had received and on what date. We also moved the reconciliations into the monthly cycle, so the year-end stopped being a rebuild. The file reconciles. Month-end closes in 4 days instead of 11 weeks, and the year-end is a review rather than a reconstruction.

Your Transfer Pricing Audit Defence Questions, Answered

Direct answers to what Canadian business owners actually ask before hiring an accountant.

How much does Transfer Pricing Audit Defence cost in Canada?

Transfer Pricing Audit Defence starts at a fixed fee quoted before any work begins. The quote is locked at the outset and does not change mid-engagement, and you pay only after you have reviewed and approved the deliverable. Compare every plan on our transparent pricing page.

What documents do I need for Transfer Pricing Audit Defence?

At minimum: prior-year returns and notices of assessment, your bank and credit-card statements for the fiscal period, payroll records if you have employees, and GST/HST filings. We send a checklist tailored to your situation after the free 15-minute call.

How long does Transfer Pricing Audit Defence take?

Most engagements are completed within 3 to 5 business days once your documents are complete. Catch-up work covering multiple years takes longer, and we tell you the realistic timeline before you commit rather than after.

What happens if the CRA reviews or audits my filing?

We respond on your behalf at no extra charge for any return we prepared. Every figure we file is supported by documentation retained in your file, which is what turns a CRA review from a crisis into correspondence. See how our CRA audit representation works.

Can you handle late or missed filings?

Yes. Late filing penalties compound at 5% of the balance owing plus 1% per month, so the cost of waiting is real. We prioritise catch-up work and, where eligible, file under the CRA's Voluntary Disclosures Program to reduce penalties.

Do you work with businesses outside major cities?

Yes. We serve clients in every province and territory at the same fixed fees, so your location does not change the price or the service. Browse our coverage across Canada to find your city.

Which industries do you specialise in for Transfer Pricing Audit Defence?

We work across construction, healthcare, e-commerce, professional services, restaurants, real estate, transportation, technology and non-profits, each with its own deduction profile and CRA scrutiny patterns. See all industries we serve.

What makes Transfer Pricing Audit Defence different from filing it myself?

Software applies the rules you already know about. An experienced tax accountant finds the ones you do not: capital cost allowance timing, the small business deduction threshold, shareholder loan repayment rules, and TOSI exposure on family dividends. The fee is usually smaller than the deductions it surfaces.

What is included in Transfer Pricing Audit Defence services?

Our transfer pricing audit defence services include complete filing, compliance management, and strategic advice customized to Canadian tax laws.

How do I start with Transfer Pricing Audit Defence services?

You can start by booking a free 15-minute call. We will review your files, provide a fixed quote, and start working immediately.

What records should I gather before starting transfer pricing audit defence?

We get this one a lot, and the answer is more concrete than people expect. The VDP can waive gross-negligence penalties and part of the interest on unreported income or unfiled returns — but only while the disclosure is genuinely voluntary. The window closes the moment the CRA makes contact about the issue. Acting before that letter arrives is worth real money. Bring your documents and we will show you where it lands in your numbers.

What does a tax advisor actually check during transfer pricing audit defence?

The late-filing penalty is 5% of the balance owing plus 1% for each full month late, to a maximum of twelve months. A second late filing within three years doubles both figures. The penalty is calculated on the balance owing, so a late return with nothing owing costs nothing — which is why filing on time matters even when you cannot pay. That is the part most owners have not heard before they sit down with us, and it usually changes what they do next.

More Transfer Pricing Audit Defence Questions Canadians Ask

The questions Canadians actually search on this topic, answered plainly. Browse every question in the Canadian tax answers directory.

Yes, the CRA does telephone people, usually about a balance owing, a missing return, an audit or to verify information, and calls can come from many different numbers, so caller ID proves nothing either way. A real agent never demands payment by gift card, cryptocurrency or e-transfer, never threatens immediate arrest or deportation, and never asks for a password. If a call feels wrong, hang up, check your balance and mail in My Account, then call back using a number from canada.ca.

Yes. A personal T1 can be prepared and filed by the taxpayer through CRA-certified software, and a straightforward year of employment slips and a few credits is manageable. Corporate filing is harder: a T2 has to reconcile to financial statements, and for tax years beginning after 2023 electronic filing is mandatory for essentially every corporation regardless of gross revenue. Self-employment, rental property, investments sold during the year, a move between provinces and foreign income are where self-filed returns most often go wrong.

There are three routes: file online yourself through NETFILE certified software, have a preparer transmit it by EFILE, or mail a paper return to your CRA tax centre. Online filing returns a confirmation number straight away, and that number is your proof of filing. For 2025 returns the CRA opened online filing on 23 February 2026 and closes it on 29 January 2027 for its annual changeover; when the system reopens in February 2027 a 2025 return can still be transmitted electronically, because NETFILE and EFILE accept the current tax year plus the three preceding years.

No. That measure is American and nothing equivalent has been enacted here, so there is no date on which tips stop being taxed in Canada. Tips and gratuities remain taxable income. Amounts your employer controls and distributes are normally put through payroll with income tax, CPP and EI withheld, while tips handed to you directly are still reportable on your T1, cash included. Keep a daily record, since the CRA can estimate unreported tips from sales data.

Call the individual or business tax enquiries line listed on the CRA's Contact us page, then work through the automated menu to reach an agent. Have your social insurance number or business number, your date of birth and a line amount from your last assessed return ready, because the agent cannot discuss your file without them. Wait times are longest right after the filing deadline. My Account answers many questions without a call.

For your own tax information, ask for a personal information request through the federal ATIP online portal, or submit the government's request form to the CRA's access to information office. Name the years and the type of record - notices of assessment, audit working papers, collections notes - because a narrow request is answered faster. Check CRA My Account first: slips, notices and account balances are already there at no cost.

Taxpayer information is anything the CRA holds that came from or was prepared about your tax affairs: returns, slips, assessments, balances and correspondence. The Income Tax Act binds the CRA to keep it confidential, so it cannot be released to a spouse, an accountant or a lender without your authorisation. You give that authorisation through My Account or a signed AUT-01. Sharing between the CRA and other government programs happens only where the law allows it.

No. Filing and paying are legal obligations, not choices. What is voluntary is the self-assessment design: you report your own income and calculate the tax, and the CRA verifies afterwards. Ignoring the obligation leads to penalties, compounding interest, an assessment raised without your figures, and collection action such as garnishing wages. Arguments that income tax does not apply to individuals have failed in court every time. If you have unfiled years, ask about the CRA's voluntary disclosure route before it contacts you.

Cash tips are taxable income, so leaving them off your T1 understates income and the CRA can reassess the year, charge interest and add a penalty. Where slips are missing it can estimate earnings from deposits, industry norms and lifestyle, which usually costs more than reporting honestly would have. Report the total even though it appears on no slip, and keep a daily tip log so your figure can be supported.

Prior-year returns can still be filed, and the CRA accepts several years back. Each year is filed on that year's own forms, so gather the slips and receipts for each one, pull missing slips from your CRA account, and file the oldest year first so carry-forward amounts flow correctly into later years. Interest and a late-filing penalty apply to any balance owing. If income was left out deliberately, ask about the CRA's Voluntary Disclosures Program before filing.

Travel insurance is only partly claimable. The medical portion of a travel policy generally counts as a private health services plan premium and can be included with your medical expenses, while trip cancellation, baggage and interruption coverage cannot. Ask the insurer to break the premium down, because a single quoted price will not support the claim. Insurance bought for a genuine business trip is deductible against business income instead.

Filing is required whenever tax is owing, and retirees are usually better off filing even with nothing to pay. The return is what calculates the GST/HST credit, the Guaranteed Income Supplement, provincial credits and the age and pension amounts, and it is where pension income splitting is elected. Filing on time also keeps income-tested payments flowing without interruption. For the 2025 tax year the deadline was 30 April 2026.
