CRA Notice of Objection: Our Analysis

CRA reviews are won on documentation: every figure filed should trace to a source document, and deadlines — 90 days for an objection — are unforgiving. The Voluntary Disclosures Program can waive gross-negligence penalties and part of the interest — but only while the CRA has not yet contacted you. Our cra notice of objection engagement is priced as a pocket-friendly flat fee, so the cost is known before the work starts.

A Tax Preparation Specialist's Notes on CRA Notice of Objection

Most of what goes wrong with cra notice of objection goes wrong before anyone opens the software. As a tax preparation specialist, that is where these notes on CRA Notice of Objection begin.

First, the rule that sorts straightforward files from complicated ones: Once the CRA confirms an assessment or reassesses following an objection, the next step is an appeal to the Tax Court of Canada within 90 days. An extension has to be applied for rather than assumed, and the merits of the position do not extend the deadline.

The second point follows directly from the first. A review is won on documentation created at the time, not on explanations offered afterwards. The CRA asks for the source records behind a figure, and an unsupported claim is simply disallowed. Most reassessments we reverse are not the result of a wrong position — they are the result of a correct position with no contemporaneous paper trail behind it. One more rule deserves attention, mostly because ignoring it is expensive in ways that only show up later. The VDP can waive gross-negligence penalties and part of the interest on unreported income or unfiled returns — but only while the disclosure is genuinely voluntary. The window closes the moment the CRA makes contact about the issue. Acting before that letter arrives is worth real money.

Think of these rules as the fixed terrain; your circumstances decide the route through it. Mapping that route is the work a tax preparation specialist takes off your plate for cra notice of objection. Gather whatever records touch the numbers — statements, ledgers, prior-year filings — and we take it from there.

As with everything we file: fixed fee agreed first, your review before submission, payment after service.

Case Study 1

$870,000 Sheltered By The Lifetime Capital Gains Exemption — Contractor Facing Reassessment, Kelowna

A contractor facing a proposed reassessment in Kelowna, British Columbia was preparing to sell. However, a minute book with no resolutions behind a decade of dividends disqualified the shares. Purification sheltered $870,000 under the exemption.

A contractor facing a proposed reassessment in Kelowna, British Columbia had an offer on the table and 27 months to close. The shares did not qualify for the capital gains exemption. A minute book with no resolutions behind a decade of dividends was part of the reason. We purified the corporation so the shares met the qualifying tests. We filed the disclosure through the Voluntary Disclosures Program before contact, which removed the gross-negligence penalty entirely. All of it was done well ahead of the closing date. The sale closed on schedule with $870,000 sheltered by the lifetime capital gains exemption across the shareholders.

Case Study 2

Notice Of Objection Allowed In Full, $82,000 Reversed — Long-Term Non-Filer, Guelph

An $82,000 reassessment landed at a taxpayer with eight years of unfiled returns in Guelph, Ontario. It rested on a net-worth assessment built on unexplained deposits that were actually loan proceeds. The objection was allowed in full.

A taxpayer with eight years of unfiled returns in Guelph, Ontario had been reassessed for $82,000. 18 days were left on the objection deadline. The reassessment rested on a net-worth assessment built on unexplained deposits that were actually loan proceeds. We filed the objection inside the deadline with a complete submission rather than a placeholder. Alongside it, we kept the waiver narrowed to the issue actually under review and let the remaining years close on the normal reassessment period. The appeals officer allowed the objection in full. $82,000 was reversed and the account returned to a nil balance.

Case Study 3

$160,000 Of Working Capital Freed From The Tax Cycle — Corporation Under GST/HST Review, Lethbridge

A corporation under a GST/HST review in Lethbridge, Alberta was profitable and permanently short of cash. Behind the gap sat six years of unfiled corporate and personal returns and an active collections file. Restructuring the tax cycle freed $160,000.

A corporation under a GST/HST review in Lethbridge, Alberta was profitable on paper and short of cash every month. Six years of unfiled corporate and personal returns and an active collections file explained most of the gap. We requested the auditor’s working papers and report to see how the assessment had been built before answering any of it. We also built a thirteen-week cash view so tax payments stopped competing with payroll for the same dollars. $160,000 was released back into working capital. Remittances have been on time every period since, and the forecast shows the tax outflow before it lands.

Case Study 4

$58,000 Reassessment Reduced To Nil On Review — Director Facing Assessment, Toronto

A $58,000 reassessment was proposed against a business owner with a director liability assessment in Toronto, Ontario. It followed a proposal letter with a 30-day response window and no supporting records assembled. The documented response reduced it to nil.

A review notice arrived at a business owner with a director liability assessment in Toronto, Ontario, covering CRA notice of objection for two tax years. The auditor's working position was an adjustment of $58,000. It was driven by a proposal letter with a 30-day response window and no supporting records assembled. Rather than negotiate, we rebuilt the record. We brought every outstanding return current, then negotiated a payment arrangement that stopped the collections action. We then submitted a point-by-point response that answered each proposed adjustment with the document behind it. The auditor accepted the documented position and closed the review without adjustment, protecting $58,000 and leaving the prior filings undisturbed.

Case Study 5

Collections Halted And $142,000 Cut From A 4-Year Backlog — Professional Under Lifestyle Audit, Calgary

Collections had begun against a professional under a lifestyle audit in Calgary, Alberta over 4 years of unfiled returns. Bringing them current cut $142,000 from the balance.

By the time a professional under a lifestyle audit in Calgary, Alberta called, 4 years were outstanding. The CRA had assessed on estimates. Underneath it sat a confirmation letter left in a drawer until the appeal window had closed. We reconstructed the records year by year. We answered each query in writing with an indexed document package, so the file showed exactly what the auditor had received and on what date. Each filing replaced an arbitrary assessment with a real one. The account is current. Filing on real numbers rather than CRA estimates reduced the balance by $142,000, and a relief application addressed part of the accumulated interest.

Case Study 6

Filed On Time From A Standing Start, $118,000 Penalty Avoided — Employer Under Payroll Review, Vancouver

A company facing a payroll trust examination in Vancouver, British Columbia was 10 weeks from a deadline. The file also carried an audit conducted over the phone, with nothing on file showing what had been provided or when. Filing complete and on time avoided roughly $118,000 in penalties.

A company facing a payroll trust examination in Vancouver, British Columbia came to us 10 weeks before its filing deadline. The file came with an audit conducted over the phone, with nothing on file showing what had been provided or when. A late filing would have triggered a penalty of roughly $118,000 before interest. We worked backwards from the deadline. We filed the Tax Court appeal inside the window and resolved the remaining adjustments before a hearing date was needed. We prioritised the items that actually gated the filing and deferred everything that did not. The return was filed on time and complete. The $118,000 penalty never arose, and the compliance calendar we set means the next deadline is scheduled rather than discovered.

Frequently Asked Questions on CRA Notice of Objection Filing

Direct answers to what Canadian business owners actually ask before hiring an accountant.

How much does CRA Notice of Objection cost in Canada?

CRA Notice of Objection starts at a fixed fee quoted before any work begins. The quote is locked at the outset and does not change mid-engagement, and you pay only after you have reviewed and approved the deliverable. Compare every plan on our transparent pricing page.

What documents do I need for CRA Notice of Objection?

At minimum: prior-year returns and notices of assessment, your bank and credit-card statements for the fiscal period, payroll records if you have employees, and GST/HST filings. We send a checklist tailored to your situation after the free 15-minute call.

How long does CRA Notice of Objection take?

Most engagements are completed within 3 to 5 business days once your documents are complete. Catch-up work covering multiple years takes longer, and we tell you the realistic timeline before you commit rather than after.

What happens if the CRA reviews or audits my filing?

We respond on your behalf at no extra charge for any return we prepared. Every figure we file is supported by documentation retained in your file, which is what turns a CRA review from a crisis into correspondence. See how our CRA audit representation works.

Can you handle late or missed filings?

Yes. Late filing penalties compound at 5% of the balance owing plus 1% per month, so the cost of waiting is real. We prioritise catch-up work and, where eligible, file under the CRA's Voluntary Disclosures Program to reduce penalties.

Do you work with businesses outside major cities?

Yes. We serve clients in every province and territory at the same fixed fees, so your location does not change the price or the service. Browse our coverage across Canada to find your city.

Which industries do you specialise in for CRA Notice of Objection?

We work across construction, healthcare, e-commerce, professional services, restaurants, real estate, transportation, technology and non-profits, each with its own deduction profile and CRA scrutiny patterns. See all industries we serve.

What makes CRA Notice of Objection different from filing it myself?

Software applies the rules you already know about. An experienced tax accountant finds the ones you do not: capital cost allowance timing, the small business deduction threshold, shareholder loan repayment rules, and TOSI exposure on family dividends. The fee is usually smaller than the deductions it surfaces.

What is included in CRA Notice of Objection services?

Our cra notice of objection services include complete filing, compliance management, and strategic advice customized to Canadian tax laws.

How do I start with CRA Notice of Objection services?

You can start by booking a free 15-minute call. We will review your files, provide a fixed quote, and start working immediately.

What records should I gather before starting cra notice of objection?

The short answer comes straight from our working notes: The VDP can waive gross-negligence penalties and part of the interest on unreported income or unfiled returns — but only while the disclosure is genuinely voluntary. The window closes the moment the CRA makes contact about the issue. Acting before that letter arrives is worth real money. How that plays out on your file depends on the specifics, which is exactly what the engagement is for.

What does a tax expert actually check during cra notice of objection?

The late-filing penalty is 5% of the balance owing plus 1% for each full month late, to a maximum of twelve months. A second late filing within three years doubles both figures. The penalty is calculated on the balance owing, so a late return with nothing owing costs nothing — which is why filing on time matters even when you cannot pay. That is the part most owners have not heard before they sit down with us, and it usually changes what they do next.

More CRA Notice of Objection Questions Canadians Ask

The questions Canadians actually search on this topic, answered plainly. Browse every question in the Canadian tax answers directory.

Start with the basic personal amount, which is already printed on the form, then add only the credits you genuinely expect to claim, such as tuition you will pay this year, an eligible dependant, the age amount or an amount transferred from a spouse. Total them, sign and date, and give the form to your employer rather than the CRA. With two jobs, claim the amounts at one only. You can also ask for extra tax to be withheld.

Download them from the forms and publications section of canada.ca, where current and prior-year federal and provincial forms sit as printable PDFs. During filing season paper packages are also stocked at some Canada Post and Service Canada outlets, and the CRA will post a package if you order one by phone. Filing software completes the same forms behind the scenes, so most people never need the printed version at all.

Check My Account, which shows your current balance, any instalment requirement and the assessment for every year. The notice of assessment for your last filed return also states the balance, and the CRA's individual enquiries line can confirm it once you verify your identity. If returns are missing, the balance is not final until those years are filed. A representative can review it for you once authorised through Represent a Client or form AUT-01.

The individual and business enquiry numbers, along with their hours, are listed on the CRA contact page. Have your social insurance number or business number and a figure from a recent return ready, because the agent must verify you before discussing anything. Many tasks never need a call: CRA My Account and My Business Account show balances, assessments, slips and instalments, and let you file a dispute, change a return or set up a payment arrangement.

Two separate charges apply. Filing late costs 5% of the balance owing plus 1% for each full month the return is late, to a maximum of 12 months. Paying late costs compound daily interest on the unpaid balance at the CRA's prescribed rate, which is reset every quarter. Interest also runs on the penalty itself. Check the current quarterly rate on the CRA's prescribed interest rates page before estimating what you owe.

No. Filing and paying are legal obligations, not choices. A return is required if you have tax payable, and also whenever the CRA asks you to file. Filing late with a balance owing brings a late-filing penalty that grows for each month the return is outstanding, plus compound interest on the balance. Prolonged non-filing can end in an arbitrary assessment, a wage garnishment or a lien. If you cannot pay, still file on time and arrange payment terms.

A review is not an audit. The CRA asks for receipts or documents supporting a claim, gives a date to respond, then either accepts the return as filed or issues a reassessment. Timing depends on the type of review and how fast complete documents arrive; sending everything requested in one package is the fastest route. Track progress in CRA My Account, where the letter and the outcome both appear.

You remain responsible for what your return says, even when someone else prepared it, so the CRA assesses the tax, interest and penalties against you. A preparer who makes or participates in a false statement can face third-party penalties of their own, and may be liable to you for negligence, which is why engagement terms and professional insurance matter. Keep your source documents for six years from the end of the tax year they relate to.

Personal and living costs never are: your own groceries, everyday clothing, commuting between home and a regular workplace, and home costs without a qualifying work space. In a business, capital purchases are written off over time through capital cost allowance rather than expensed, club dues and most memberships are denied, only a portion of meals and entertainment is allowed, and fines, penalties and interest charged by the CRA are not deductible. Political contributions and donations give credits, not expense deductions.

Child care is a federal deduction, not a credit. Eligible fees paid so you can work, run a business, or study are deducted from income, normally by the spouse with the lower net income, subject to an annual limit per child that depends on the child age and disability status. Keep receipts showing the provider name and social insurance number or business number. Quebec adds a refundable provincial credit for child care, and several provinces subsidise fees directly.

The choice does not exist here. Every individual files their own return, so the real decision is which return claims what. Charitable donations, medical expenses and several family credits can generally go on either partner's return, and eligible pension income can be split between you. Preparing both returns at the same time lets you test those allocations and pick the combination that gives the lowest total tax for the household rather than for one person.

No. A fine or penalty imposed under a law of Canada, a province or a foreign country is not deductible, so speeding tickets, camera charges and parking fines stay a personal cost even when you were driving for work. If a business pays an employee's ticket, that is a taxable benefit to the employee. Towing, licence fees and legitimate paid parking on a business trip are deductible, so record those separately from fines in your bookkeeping.
