US Form 1120 Filing: Our Analysis

The T1135 foreign income verification statement applies once specified foreign property passes $100,000 in cost — late-filing penalties start at $25 a day. We quote us form 1120 filing as one affordable fixed price — the budget-friendly alternative to hourly billing.

Field Notes: US Form 1120 Filing

If you handle US Form 1120 Filing once a year, everything looks equally important. Handle it weekly, as a tax professional does, and a clear hierarchy emerges; these notes follow that hierarchy.

The first thing we verify on every engagement: The Canada–US treaty allocates taxing rights, but relief is not automatic. A foreign tax credit or treaty position has to be claimed on a filed return.

It would be simpler if the story ended there, but a second rule enters almost immediately. Departure from Canada triggers a deemed disposition of most property at fair market value. The resulting gain has to be reported on the final resident return. Then there is the matter of timing, which forgives very little: A payment to a non-resident for services performed in Canada is subject to 15 percent withholding under Regulation 105. That applies whether or not the non-resident ends up owing Canadian tax. A waiver has to be applied for before the payment is made, and the payer that withheld nothing is the one assessed.

What this means for you: the value in us form 1120 filing is not the filing itself, it is having a tax professional apply these rules to your numbers before anything is submitted. Here is what to have on hand so the us form 1120 filing work starts moving on day one.

As with everything we file: fixed fee agreed first, your review before submission, payment after service.

US Form 1120 Filing Tax & Accounting Case Studies

See how our expert US Form 1120 Filing tax and accounting services have helped Canadian businesses save money and stay compliant.

Case Study 1

Instalments Rebased, $155,000 Of Cash Returned To The Business — Inbound Assignee, Guelph

An inbound transferee on assignment in Guelph, Ontario was overpaying instalments. The cause was US tax paid but no foreign tax credit claimed on the Canadian return. Rebasing them returned $155,000 to the business.

An inbound transferee on assignment in Guelph, Ontario was paying instalments calculated on a prior year. That year no longer reflected the business. US tax paid but no foreign tax credit claimed on the Canadian return was tying up $155,000 of cash. We rebased the instalments on the current-year estimate rather than the prior-year default. Alongside that, we registered the payer for a non-resident withholding account, remitted the Regulation 105 amounts due, and applied for waivers covering the rest of the contract. $155,000 of cash stayed in the business, the penalty cycle ended, and the instalment position is reviewed each quarter against actual results.

Case Study 2

Incentive Review Recovered $43,000 Across 7 Open Years — Mid-Year Emigrant, Winnipeg

An incentive review at an emigrant who left Canada mid-year in Winnipeg, Manitoba recovered $43,000 across 7 open years. It found US tax paid but no foreign tax credit claimed on the Canadian return.

An incentive review at an emigrant who left Canada mid-year in Winnipeg, Manitoba started from a simple question: what has never been claimed? The answer ran to 7 years. It was driven by US tax paid but no foreign tax credit claimed on the Canadian return. We reconstructed the day count on both sides of the border and documented the residency and treaty position before either revenue authority asked. We documented eligibility to the standard a reviewer would apply rather than the standard a claim form requires. The credits produced $43,000 across the open years. The tracking now in place means the following year's claim is documented as the work happens rather than reconstructed afterwards.

Case Study 3

$780,000 Sheltered By The Lifetime Capital Gains Exemption — Non-Resident Landlord, Regina

A non-resident owning Canadian rental property in Regina, Saskatchewan was preparing to sell. However, no valuation on file to support the price the parties had agreed disqualified the shares. Purification sheltered $780,000 under the exemption.

A non-resident owning Canadian rental property in Regina, Saskatchewan had an offer on the table and 24 months to close. The shares did not qualify for the capital gains exemption. No valuation on file to support the price the parties had agreed was part of the reason. We purified the corporation so the shares met the qualifying tests. We filed the outstanding T1135 disclosures through the Voluntary Disclosures Program, which eliminated the penalty exposure entirely. All of it was done well ahead of the closing date. The sale closed on schedule with $780,000 sheltered by the lifetime capital gains exemption across the shareholders.

Case Study 4

$110,000 Late-Filing Penalty Cancelled On Relief Application — US-Facing Canadian Corporation, Lethbridge

A Canadian corporation with US customers in Lethbridge, Alberta had already been penalised. The issue was a US LLC taxed as a corporation in Canada, producing double tax on the same income. A relief application cancelled $110,000 of that penalty.

A Canadian corporation with US customers in Lethbridge, Alberta had already missed one deadline and was about to miss a second. Behind it sat a US LLC taxed as a corporation in Canada, producing double tax on the same income. A penalty of $110,000 was accruing. We split the work into what had to happen before the deadline and what could follow it. Then we filed the section 216 election with the supporting rental statements and recovered the excess withholding as a refund. The outstanding return was accepted as filed, and the taxpayer relief application cancelled $110,000 of the penalty already assessed on the earlier year.

Case Study 5

Second-Province Expansion Handled, $47,000 Of Cash Released — US Rental Owner, Hamilton

A Canadian resident with a US rental property in Hamilton, Ontario expanded into a second province. The file already carried foreign accounts that had passed the $100,000 T1135 threshold three years earlier. Every obligation was set up in advance and $47,000 of cash released.

Revenue at a Canadian resident with a US rental property in Hamilton, Ontario was up sharply and cash was tighter than ever. Underneath it sat foreign accounts that had passed the $100,000 T1135 threshold three years earlier. We applied the treaty rate to the dividend withholding, filed the NR4 return, and remitted the shortfall before the CRA assessed the payer for it. Every new obligation was set up before it was triggered, not after. That covered registration, remittance frequency and provincial filing. $47,000 of cash was released from the working capital cycle. The expansion completed with every registration and filing obligation covered from day one.

Case Study 6

Audit Defence Closed In 9 Weeks, $41,000 Cleared — Florida Property Owner, Kitchener

A family with a Florida vacation property in Kitchener, Ontario was under review. The issue was winters spent in the United States with the day count kept casually and no residency position documented anywhere. The file closed in 9 weeks with $41,000 of proposed tax cleared.

A family with a Florida vacation property in Kitchener, Ontario was selected for review. Winters spent in the United States with the day count kept casually and no residency position documented anywhere had shown up in the CRA's automated matching. The proposed adjustment on US form 1120 filing came to $41,000. We aligned the Canadian and US reporting of the same income so the foreign tax credit claim carried support on both returns. Every figure in the response traced to a source record the auditor could verify without asking a second question. The review closed with no change. $41,000 of proposed tax came off the table, and the documentation now in place makes the next review a short one.

Common Questions Before Starting US Form 1120 Filing Work

Direct answers to what Canadian business owners actually ask before hiring an accountant.

How much does US Form 1120 Filing cost in Canada?

US Form 1120 Filing starts at a fixed fee quoted before any work begins. The quote is locked at the outset and does not change mid-engagement, and you pay only after you have reviewed and approved the deliverable. Compare every plan on our transparent pricing page.

What documents do I need for US Form 1120 Filing?

At minimum: prior-year returns and notices of assessment, your bank and credit-card statements for the fiscal period, payroll records if you have employees, and GST/HST filings. We send a checklist tailored to your situation after the free 15-minute call.

How long does US Form 1120 Filing take?

Most engagements are completed within 3 to 5 business days once your documents are complete. Catch-up work covering multiple years takes longer, and we tell you the realistic timeline before you commit rather than after.

What happens if the CRA reviews or audits my filing?

We respond on your behalf at no extra charge for any return we prepared. Every figure we file is supported by documentation retained in your file, which is what turns a CRA review from a crisis into correspondence. See how our CRA audit representation works.

Can you handle late or missed filings?

Yes. Late filing penalties compound at 5% of the balance owing plus 1% per month, so the cost of waiting is real. We prioritise catch-up work and, where eligible, file under the CRA's Voluntary Disclosures Program to reduce penalties.

Do you work with businesses outside major cities?

Yes. We serve clients in every province and territory at the same fixed fees, so your location does not change the price or the service. Browse our coverage across Canada to find your city.

Which industries do you specialise in for US Form 1120 Filing?

We work across construction, healthcare, e-commerce, professional services, restaurants, real estate, transportation, technology and non-profits, each with its own deduction profile and CRA scrutiny patterns. See all industries we serve.

What makes US Form 1120 Filing different from filing it myself?

Software applies the rules you already know about. An experienced tax accountant finds the ones you do not: capital cost allowance timing, the small business deduction threshold, shareholder loan repayment rules, and TOSI exposure on family dividends. The fee is usually smaller than the deductions it surfaces.

What is included in US Form 1120 Filing services?

Our us form 1120 filing services include complete filing, compliance management, and strategic advice customized to Canadian tax laws.

How do I start with US Form 1120 Filing services?

You can start by booking a free 15-minute call. We will review your files, provide a fixed quote, and start working immediately.

What records should I gather before starting us form 1120 filing?

Let us give you the substance first and the caveats second. Non-residents earning Canadian rental income face 25% withholding on gross rent unless a section 216 election is filed. The election taxes the net instead. The caveat is simply that facts on your file can shift the outcome, so treat this as the baseline rather than the final word.

How is your approach to us form 1120 filing different from doing it through software?

You are asking the right question, and it has a real answer. A US LLC is a flow-through for US purposes but a corporation for Canadian purposes. That mismatch routinely produces double taxation unless the structure is corrected. What we add on top of that is the paperwork discipline that makes the answer stand up if anyone ever asks you to prove it.

What Canadians Search About US Form 1120 Filing

The questions Canadians actually search on this topic, answered plainly. Browse every question in the Canadian tax answers directory.

Paper returns go to the CRA tax centre that serves your province or territory of residence, not to one national address. The correct address is printed in the paper return package and listed on canada.ca under mailing addresses for individual returns, and it differs for non-residents and for business returns. Filing electronically is much faster: for the 2025 tax year the CRA aims to issue a refund on an online return in about two weeks, against a considerably longer standard on paper.

Multiply the pre-tax price by the combined rate for the province where the supply is made, then add that amount to the price. If the price already includes tax, divide the total by one plus the rate to get the pre-tax amount, and the difference is the tax. The rate depends on the province of supply rather than where your business sits, so verify the current rate for that province and confirm the item is not zero-rated or exempt.

Multiply the pre-tax price by the rate for the province of supply. On a $100 purchase in 2026 that is $13.00 in Ontario (13%), $14.00 in Nova Scotia (14%), and $15.00 in New Brunswick, Newfoundland and Labrador or Prince Edward Island (15%). In the non-participating provinces and the three territories only the 5% GST applies, so $5.00, plus any provincial sales tax billed separately.

It should not. A T4A reports fees for services before sales tax, so the box amount is meant to exclude GST/HST. Some payers get this wrong and include the tax, which overstates the income the CRA sees against your name. Compare the slip with your own invoices and ask the payer for an amended slip if it is inflated. Report revenue net of GST/HST on your T2125 and account for the tax collected on your GST/HST return.

If you filed online, the CRA usually issues a refund in about two weeks once the return is assessed. A non-resident return can take up to 16 weeks. Direct deposit lands faster than a cheque. Timing slips if the CRA reviews a claim and asks for receipts, or if you owe other federal or provincial debts, which are offset against the refund first. Track the status in My Account.

When you file electronically the software returns a confirmation number, which means the CRA received the return. Acceptance is the next step: the return is assessed and a notice of assessment issued, usually about two weeks after an online filing. CRA My Account shows the return status, the notice and any refund or balance owing. If nothing appears well past that window, confirm the submission actually transmitted rather than filing a second copy.

Canada does not use tax classes or tax codes the way some other countries do. Your income tax comes from graduated brackets, with federal rates for 2026 running from 14% up to 33% and separate provincial brackets on top, and from the credits you claim on the personal tax credits return you give your employer. In a business setting, tax class usually means a capital cost allowance class, which sets the rate at which you depreciate an asset.

Federal personal income tax is progressive: several brackets apply, each only to the slice of taxable income inside it, and the thresholds are indexed annually, so read the CRA table for the year you are filing. Provincial tax is charged on top of it. For corporations the federal small business rate is 9% on the first $500,000 of active business income for 2026, and the federal general net rate is 15% for the same year.

Most dental care is exempt. Diagnosis and treatment provided by a dentist or dental hygienist, including exams, cleanings, fillings, extractions and root canals, carries no HST. Purely cosmetic work with no medical or reconstructive purpose, such as whitening or veneers done for appearance alone, is taxable at 13%. Orthodontic appliances and most dental prostheses are zero-rated. Ask the office to flag any taxable line on the treatment plan before you agree to the work.

Retirement income is taxed at the same graduated federal and provincial rates as employment income, so the bill depends on how much you draw and from which sources. CPP, OAS, employer pension payments and RRSP or RRIF withdrawals are fully taxable, while TFSA withdrawals are not, and eligible dividends and capital gains in a non-registered account are taxed more lightly. Age and pension credits, plus pension income splitting between spouses, usually bring the total down.

Yes. The CRA runs a leads programme for reporting suspected tax cheating, and you can submit online, by phone or by mail, anonymously if you prefer. Give facts, names, dates and amounts where you have them, because the CRA cannot come back with questions if you stay anonymous. It will never tell you the outcome, since confidentiality rules cover the other taxpayer. A separate offshore informant programme can pay an award on large international cases.

None of it, if you are a resident of Canada for tax purposes. Residents report worldwide income in Canadian dollars, whatever tax was already paid abroad. Relief comes from the foreign tax credit and from treaty rules, so double taxation is reduced rather than the income being ignored. Non-residents are taxed only on Canadian-source income. Holding foreign property above a reporting threshold also triggers a separate annual information return, which is a disclosure obligation rather than a tax.
