Tax Court Accounting Support: Our Analysis

The Voluntary Disclosures Program can waive gross-negligence penalties and part of the interest — but only while the CRA has not yet contacted you. Because the fee is fixed and low-cost, the economics stay predictable whether your file is simple or messy.

What Our Tax Court Rules Service Includes

Most write-ups of tax court accounting support describe the form. These notes describe the file — what an accounting firm checks first and why.

The foundation is simple to state and easy to trip over: Taxpayer relief applications can cancel penalties and interest arising from CRA delay, serious illness or a natural disaster. The CRA is limited to the ten prior calendar years.

A related rule tends to get overlooked precisely because the first one draws all the attention: The normal reassessment period runs three years from the original notice of assessment for an individual or a CCPC and four years for other corporations. A waiver signed at an auditor’s request removes that limit for the issue it describes. It stays open until it is revoked. The third rule is where the real exposure hides. Once the CRA confirms an assessment or reassesses following an objection, the next step is an appeal to the Tax Court of Canada within 90 days. An extension has to be applied for rather than assumed, and the merits of the position do not extend the deadline.

For you, the takeaway is less about memorizing rules and more about timing the conversation. Bringing an accounting firm in early on tax court accounting support means the rules shape the file instead of correcting it. Here is what to have on hand so the tax court accounting support work starts moving on day one.

We keep the commercial side simple. The fee is fixed and agreed in advance, the file is reviewed with you before filing, and you pay after the service — in that order, every time.

Case Study 1

6 Years Filed, $46,000 Removed From The Assessed Balance — Importer Under Audit, Brampton

6 years of returns were outstanding at an importer under a customs and GST audit in Brampton, Ontario. That came on top of a director liability assessment for a corporation that had already stopped operating. Filing on real numbers removed $46,000 of assessed tax.

An importer under a customs and GST audit in Brampton, Ontario had not filed for 6 years. The CRA had issued arbitrary assessments. The business was carrying a director liability assessment for a corporation that had already stopped operating. That came on top of a growing interest balance. We started with the oldest year and worked forward so each year's closing balances fed the next. We filed the disclosure through the Voluntary Disclosures Program before contact, which removed the gross-negligence penalty entirely. We filed the years in sequence rather than all at once. Every year is now filed and assessed on actual figures. The notional assessments were vacated and $46,000 of the estimated balance came off, with a payment arrangement covering the rest.

Case Study 2

Instalments Rebased, $149,000 Of Cash Returned To The Business — Late-Objection Taxpayer, Ottawa

A taxpayer whose objection window has closed in Ottawa, Ontario was overpaying instalments. The cause was an objection deadline that had passed with no extension applied for. Rebasing them returned $149,000 to the business.

A taxpayer whose objection window has closed in Ottawa, Ontario was paying instalments calculated on a prior year. That year no longer reflected the business. An objection deadline that had passed with no extension applied for was tying up $149,000 of cash. We rebased the instalments on the current-year estimate rather than the prior-year default. Alongside that, we filed the Tax Court appeal inside the window and resolved the remaining adjustments before a hearing date was needed. $149,000 of cash stayed in the business, the penalty cycle ended, and the instalment position is reviewed each quarter against actual results.

Case Study 3

Share Sale Restructured, $690,000 Less Tax On Closing — Voluntary Disclosure Applicant, Kelowna

Due diligence at a business owner considering a voluntary disclosure in Kelowna, British Columbia surfaced a single shareholder holding every share, with no room to multiply the exemption. Restructuring the sale saved $690,000 against the original terms.

A business owner considering a voluntary disclosure in Kelowna, British Columbia was preparing to sell. Due diligence surfaced a single shareholder holding every share, with no room to multiply the exemption. That would have reduced the price or killed the deal outright. We cleaned up the historical file. We brought every outstanding return current, then negotiated a payment arrangement that stopped the collections action. Then we prepared the due-diligence package the buyer's advisers actually asked for. The deal closed at the agreed price. $690,000 of tax was saved against the structure originally proposed, with no post-closing adjustment.

Case Study 4

22 Months Reconciled And $19,500 Of Input Tax Recovered — Assessed Shareholder, Regina

22 months of records at a shareholder assessed on a taxable benefit in Regina, Saskatchewan had never been reconciled. That left an audit conducted over the phone, with nothing on file showing what had been provided or when. Rebuilding recovered $19,500.

Nothing reconciled at a shareholder assessed on a taxable benefit in Regina, Saskatchewan. Every filing started with 22 months of cleanup. The file was carrying an audit conducted over the phone, with nothing on file showing what had been provided or when. We rebuilt from source rather than correcting on top of the existing file. We answered each query in writing with an indexed document package, so the file showed exactly what the auditor had received and on what date. Then we set the routine that keeps it clean. 22 months reconciled to the bank. The close now takes 7 days, and $19,500 of previously unclaimable input tax was recovered in the process.

Case Study 5

Incentive Review Recovered $80,000 Across 5 Open Years — Taxpayer Relief Applicant, Winnipeg

An incentive review at a taxpayer applying for relief from penalties and interest in Winnipeg, Manitoba recovered $80,000 across 5 open years. It found a director liability assessment for a corporation that had already stopped operating.

An incentive review at a taxpayer applying for relief from penalties and interest in Winnipeg, Manitoba started from a simple question: what has never been claimed? The answer ran to 5 years. It was driven by a director liability assessment for a corporation that had already stopped operating. We requested the auditor’s working papers and report to see how the assessment had been built before answering any of it. We documented eligibility to the standard a reviewer would apply rather than the standard a claim form requires. The credits produced $80,000 across the open years. The tracking now in place means the following year's claim is documented as the work happens rather than reconstructed afterwards.

Case Study 6

6-Week Turnaround Beat The Deadline And Saved $48,000 — Restaurant Under Net-Worth Audit, Guelph

A 6-week rebuild at a restaurant under a net-worth audit in Guelph, Ontario got the filing in with 19 days to spare. That avoided $48,000 in penalties.

A restaurant under a net-worth audit in Guelph, Ontario was weeks away from the deadline for tax court accounting support. Behind that sat a proposal letter with a 30-day response window and no supporting records assembled. The exposure if the date slipped was around $48,000. We traced each unexplained deposit to its source — loans, transfers between accounts, an insurance settlement — and reduced the net-worth assessment accordingly. The filing went in complete rather than provisional, so there was no amended return to follow. Filed with 19 days to spare. $48,000 in late-filing penalties avoided, and the working papers are ready for the following year.

Tax Court Accounting Support: Straight Answers to Common Questions

Direct answers to what Canadian business owners actually ask before hiring an accountant.

How much does Tax Court Accounting Support cost in Canada?

Tax Court Accounting Support starts at a fixed fee quoted before any work begins. The quote is locked at the outset and does not change mid-engagement, and you pay only after you have reviewed and approved the deliverable. Compare every plan on our transparent pricing page.

What documents do I need for Tax Court Accounting Support?

At minimum: prior-year returns and notices of assessment, your bank and credit-card statements for the fiscal period, payroll records if you have employees, and GST/HST filings. We send a checklist tailored to your situation after the free 15-minute call.

How long does Tax Court Accounting Support take?

Most engagements are completed within 3 to 5 business days once your documents are complete. Catch-up work covering multiple years takes longer, and we tell you the realistic timeline before you commit rather than after.

What happens if the CRA reviews or audits my filing?

We respond on your behalf at no extra charge for any return we prepared. Every figure we file is supported by documentation retained in your file, which is what turns a CRA review from a crisis into correspondence. See how our CRA audit representation works.

Can you handle late or missed filings?

Yes. Late filing penalties compound at 5% of the balance owing plus 1% per month, so the cost of waiting is real. We prioritise catch-up work and, where eligible, file under the CRA's Voluntary Disclosures Program to reduce penalties.

Do you work with businesses outside major cities?

Yes. We serve clients in every province and territory at the same fixed fees, so your location does not change the price or the service. Browse our coverage across Canada to find your city.

Which industries do you specialise in for Tax Court Accounting Support?

We work across construction, healthcare, e-commerce, professional services, restaurants, real estate, transportation, technology and non-profits, each with its own deduction profile and CRA scrutiny patterns. See all industries we serve.

What makes Tax Court Accounting Support different from filing it myself?

Software applies the rules you already know about. An experienced tax accountant finds the ones you do not: capital cost allowance timing, the small business deduction threshold, shareholder loan repayment rules, and TOSI exposure on family dividends. The fee is usually smaller than the deductions it surfaces.

What is included in Tax Court Accounting Support services?

Our tax court accounting support services include complete filing, compliance management, and strategic advice customized to Canadian tax laws.

How do I start with Tax Court Accounting Support services?

You can start by booking a free 15-minute call. We will review your files, provide a fixed quote, and start working immediately.

What records should I gather before starting tax court accounting support?

The honest answer comes down to one rule. A review is won on documentation created at the time, not explanations offered afterwards. An unsupported claim is simply disallowed, however correct it was. That is the part we verify before anything is filed.

How is your approach to tax court accounting support different from doing it through software?

In our files, this is the deciding factor: The Voluntary Disclosures Program can waive gross-negligence penalties and part of the interest. That relief is available only while the CRA has not yet contacted the taxpayer about the issue. A tax professional applies it to your numbers before submission.

More Tax Court Accounting Support Questions Canadians Ask

The questions Canadians actually search on this topic, answered plainly. Browse every question in the Canadian tax answers directory.

The usual route is online banking: add the CRA as a payee, choose the account type and the tax year, and pay as you would any bill. You can also use the CRA's My Payment service with a debit card, set up pre-authorised debit inside My Account, pay at your financial institution, or pay by credit card through a third-party provider that charges its own fee. Keep the confirmation, since payments do not always post to your CRA account immediately.

Yes. Employment Insurance benefits are taxable income and must be reported on your return. Service Canada issues a T4E slip showing the benefits paid and the tax already withheld, and that withholding is often less than the rate that ends up applying, because it takes no account of employment income earned earlier in the same year. Many claimants therefore owe a balance at filing. If your income for the year is high enough, part of any regular benefits may also be repayable — the repayment never touches maternity, parental or sickness benefits, and it does not apply where you have not received regular benefits in the previous ten years.

The individual and business enquiry numbers, along with their hours, are listed on the CRA contact page. Have your social insurance number or business number and a figure from a recent return ready, because the agent must verify you before discussing anything. Many tasks never need a call: CRA My Account and My Business Account show balances, assessments, slips and instalments, and let you file a dispute, change a return or set up a payment arrangement.

Pay through your bank's online bill payment, CRA My Payment, pre-authorised debit set up in My Account, a credit card through a third-party provider, or at a Canadian financial institution with a remittance voucher. Interest runs daily on an unpaid balance from the due date, so pay what you can even if you cannot clear it all. If you cannot pay in full, call the CRA to arrange a payment plan; penalty and interest relief is requested on form RC4288.

There is no single CRA fax number. Fax lines belong to particular offices and programs, so the only reliable number is the one printed on the letter you are answering. Faxing without that reference risks your documents landing in the wrong queue. Submitting them through My Account, My Business Account or Represent a Client is faster and gives you a confirmation, which a fax does not.

Spread or shelter it. Contributing to an RRSP in the same year, if you have room, offsets the income directly; the RRSP dollar limit is $33,810 for 2026 and $32,490 for 2025. Where the lump sum is a retiring allowance, part may be transferred to an RRSP outside your normal room. Qualifying retroactive lump sums can be taxed as if received in the earlier years. Ask the payer to reduce withholding only with CRA approval.

Rental profit is taxed as ordinary income at your marginal rate; there is no special landlord rate. You report gross rent and deduct current expenses such as mortgage interest, property tax, insurance, utilities, repairs, advertising, condo fees and reasonable management costs. Capital improvements are added to the property's cost rather than deducted. A rental loss can generally offset other income. On sale, the gain is a capital gain, half of which is taxable for 2025 and 2026.

Something in the mix changed. A raise or bonus can lift income into a higher bracket while withholding lags behind, a second job or contract work adds income with nothing held back, a credit or deduction claimed last year may no longer apply, and pension or investment income usually arrives with little tax withheld. Compare this year's slips against last year's return line by line, then ask your employer to withhold extra or budget for instalments.

Tips are taxable income. Controlled tips your employer distributes are already inside the employment income on your T4, so you do not add them again. Direct tips and cash tips customers hand you are not on a T4, and you report them yourself as other employment income on your T1. Keep a daily record of amounts received. Declared tips can also raise your CPP contributions and the benefits based on them, so the record matters.

There is no general exemption an individual can apply for. Minors file and are taxed the same way as anyone else, with the same personal credits. Organizations are different: a registered charity must apply to CRA and be approved, and a non-profit organization qualifies only while it is not operated for profit and no income is payable to its members. Most trusts, and all ordinary corporations including banks, stay taxable. Some museums qualify as registered charities.

You can ask, but no employer has to issue it before the CRA's annual slip deadline shortly after year end, and payroll often cannot finalise the numbers until then. If you need figures sooner, use your last pay statement of the year for gross pay, income tax, CPP and EI to date. Slips also appear in CRA My Account once the employer files them. Filing from an estimate invites a reassessment later, so wait for the slip.

A private creditor cannot take a refund from the CRA directly. CRA itself can apply your refund against tax you owe, and under federal set-off it can be redirected to other government debts such as defaulted student loans or benefit overpayments. Once the money reaches your bank account it is an ordinary asset, so a collection agency holding a court judgment and a garnishment order can seize it there. Unpaid tax is not reported to credit bureaus, although CRA can register a lien.
