US Form 1065 Partnership Filing: Our Analysis

Section 216 and 217 elections can substantially reduce non-resident withholding on Canadian rents and pensions when filed on time. Our us form 1065 partnership filing engagement is priced as a pocket-friendly flat fee, so the cost is known before the work starts.

Field Notes: US Form 1065 Partnership Filing

Clients often arrive treating us form 1065 partnership filing as a form-filling exercise. In practice, a tax practitioner spends more time on judgment calls than on data entry — and those calls are what these notes cover.

One rule does more work than the rest combined, so it goes first. The T1135 foreign income verification statement is required once specified foreign property exceeds $100,000 in cost. Late-filing penalties start at $25 a day to a maximum of $2,500 per year, before gross-negligence penalties.

From there, the file turns on a second question, and the rule behind it reads as follows. A US LLC is a flow-through for US purposes but a corporation for Canadian purposes. That mismatch routinely produces double taxation unless the structure is corrected. Calendars matter more than most people expect in us form 1065 partnership filing, and this is the rule that proves it: Non-residents earning Canadian rental income face 25% withholding on gross rent unless a section 216 election is filed. The election taxes the net instead.

None of this requires you to become an expert — that is what engaging a tax expert is for. What it does require is recognizing that us form 1065 partnership filing will reward preparation over improvisation. Nothing slows a file like missing records, so for us form 1065 partnership filing begin with.

The fee is fixed and agreed before any work starts, you review every figure, and payment happens only after the work is done.

Case Study 1

$55,000 Reassessment Reduced To Nil On Review — US Citizen in Canada, Lethbridge

A $55,000 reassessment was proposed against a US citizen living in Canada in Lethbridge, Alberta. It followed invoices paid to a non-resident consultant working on site in Canada with no Regulation 105 withholding taken. The documented response reduced it to nil.

A review notice arrived at a US citizen living in Canada in Lethbridge, Alberta, covering US form 1065 partnership filing for two tax years. The auditor's working position was an adjustment of $55,000. It was driven by invoices paid to a non-resident consultant working on site in Canada with no Regulation 105 withholding taken. Rather than negotiate, we rebuilt the record. We applied the treaty rate to the dividend withholding, filed the NR4 return, and remitted the shortfall before the CRA assessed the payer for it. We then submitted a point-by-point response that answered each proposed adjustment with the document behind it. The auditor accepted the documented position and closed the review without adjustment, protecting $55,000 and leaving the prior filings undisturbed.

Case Study 2

Collections Halted And $109,000 Cut From A 7-Year Backlog — Florida Property Owner, Red Deer

Collections had begun against a family with a Florida vacation property in Red Deer, Alberta over 7 years of unfiled returns. Bringing them current cut $109,000 from the balance.

By the time a family with a Florida vacation property in Red Deer, Alberta called, 7 years were outstanding. The CRA had assessed on estimates. Underneath it sat US tax paid but no foreign tax credit claimed on the Canadian return. We reconstructed the records year by year. We aligned the Canadian and US reporting of the same income so the foreign tax credit claim carried support on both returns. Each filing replaced an arbitrary assessment with a real one. The account is current. Filing on real numbers rather than CRA estimates reduced the balance by $109,000, and a relief application addressed part of the accumulated interest.

Case Study 3

Filed On Time From A Standing Start, $43,000 Penalty Avoided — US LLC Shareholder, Halifax

A shareholder of a US LLC in Halifax, Nova Scotia was 5 weeks from a deadline. The file also carried a departure year filed as a normal resident return with no deemed disposition reported. Filing complete and on time avoided roughly $43,000 in penalties.

A shareholder of a US LLC in Halifax, Nova Scotia came to us 5 weeks before its filing deadline. The file came with a departure year filed as a normal resident return with no deemed disposition reported. A late filing would have triggered a penalty of roughly $43,000 before interest. We worked backwards from the deadline. We restructured the US holding so the Canadian and US characterisations aligned, ending the double taxation going forward. We prioritised the items that actually gated the filing and deferred everything that did not. The return was filed on time and complete. The $43,000 penalty never arose, and the compliance calendar we set means the next deadline is scheduled rather than discovered.

Case Study 4

$74,000 Saved By Correcting What Prior Filings Had Missed — Mid-Year Emigrant, Vancouver

A second opinion for an emigrant who left Canada mid-year in Vancouver, British Columbia recovered $74,000 a year. It found 25% withholding on gross Canadian rent where a section 216 election would have taxed only the net in prior filings.

An emigrant who left Canada mid-year in Vancouver, British Columbia asked for a second opinion on US form 1065 partnership filing. That followed three years of rising tax. The review found 25% withholding on gross Canadian rent where a section 216 election would have taxed only the net. We built the comparison first: current structure against two alternatives. Then we reported the deemed disposition properly on the departure return and claimed the foreign tax credits that had been left unused. First-year saving of $74,000, with the same benefit recurring. Every position taken is documented and supported in the file.

Case Study 5

Incentive Review Recovered $138,000 Across 7 Open Years — Arizona Snowbird, Moncton

An incentive review at a snowbird spending winters in Arizona in Moncton, New Brunswick recovered $138,000 across 7 open years. It found a departure year filed as a normal resident return with no deemed disposition reported.

An incentive review at a snowbird spending winters in Arizona in Moncton, New Brunswick started from a simple question: what has never been claimed? The answer ran to 7 years. It was driven by a departure year filed as a normal resident return with no deemed disposition reported. We reconstructed the day count on both sides of the border and documented the residency and treaty position before either revenue authority asked. We documented eligibility to the standard a reviewer would apply rather than the standard a claim form requires. The credits produced $138,000 across the open years. The tracking now in place means the following year's claim is documented as the work happens rather than reconstructed afterwards.

Case Study 6

Reorganisation Completed Tax-Deferred, $66,000 Saved Each Year — US Rental Owner, Burnaby

A Canadian resident with a US rental property in Burnaby, British Columbia had outgrown its structure. The visible cost was foreign accounts that had passed the $100,000 T1135 threshold three years earlier. The reorganisation completed tax-deferred and saves $66,000 a year.

A Canadian resident with a US rental property in Burnaby, British Columbia had outgrown the structure it started with. Foreign accounts that had passed the $100,000 T1135 threshold three years earlier was the immediate problem. The longer-term one was that the structure blocked the next step. We mapped the current structure and modelled the target. Then we filed the outstanding T1135 disclosures through the Voluntary Disclosures Program, which eliminated the penalty exposure entirely. The tax-deferred elections were filed on time and the supporting valuations documented. The reorganisation completed without triggering tax, and the new structure saves approximately $66,000 a year while removing the exposure the old one carried.

US Form 1065 Partnership Filing Questions We Hear Most Often

Direct answers to what Canadian business owners actually ask before hiring an accountant.

How much does US Form 1065 Partnership Filing cost in Canada?

US Form 1065 Partnership Filing starts at a fixed fee quoted before any work begins. The quote is locked at the outset and does not change mid-engagement, and you pay only after you have reviewed and approved the deliverable. Compare every plan on our transparent pricing page.

What documents do I need for US Form 1065 Partnership Filing?

At minimum: prior-year returns and notices of assessment, your bank and credit-card statements for the fiscal period, payroll records if you have employees, and GST/HST filings. We send a checklist tailored to your situation after the free 15-minute call.

How long does US Form 1065 Partnership Filing take?

Most engagements are completed within 3 to 5 business days once your documents are complete. Catch-up work covering multiple years takes longer, and we tell you the realistic timeline before you commit rather than after.

What happens if the CRA reviews or audits my filing?

We respond on your behalf at no extra charge for any return we prepared. Every figure we file is supported by documentation retained in your file, which is what turns a CRA review from a crisis into correspondence. See how our CRA audit representation works.

Can you handle late or missed filings?

Yes. Late filing penalties compound at 5% of the balance owing plus 1% per month, so the cost of waiting is real. We prioritise catch-up work and, where eligible, file under the CRA's Voluntary Disclosures Program to reduce penalties.

Do you work with businesses outside major cities?

Yes. We serve clients in every province and territory at the same fixed fees, so your location does not change the price or the service. Browse our coverage across Canada to find your city.

Which industries do you specialise in for US Form 1065 Partnership Filing?

We work across construction, healthcare, e-commerce, professional services, restaurants, real estate, transportation, technology and non-profits, each with its own deduction profile and CRA scrutiny patterns. See all industries we serve.

What makes US Form 1065 Partnership Filing different from filing it myself?

Software applies the rules you already know about. An experienced tax accountant finds the ones you do not: capital cost allowance timing, the small business deduction threshold, shareholder loan repayment rules, and TOSI exposure on family dividends. The fee is usually smaller than the deductions it surfaces.

What is included in US Form 1065 Partnership Filing services?

Our us form 1065 partnership filing services include complete filing, compliance management, and strategic advice customized to Canadian tax laws.

How do I start with US Form 1065 Partnership Filing services?

You can start by booking a free 15-minute call. We will review your files, provide a fixed quote, and start working immediately.

What goes wrong most often with us form 1065 partnership filing?

An accountant answers this differently than a search engine, because the rule has edges. The Canada–US treaty allocates taxing rights, but relief is not automatic. A foreign tax credit or treaty position has to be claimed on a filed return. Where your business sits relative to those edges is what we establish in the first meeting.

What records do I need before starting us form 1065 partnership filing?

There is a widespread assumption here, and the actual position is worth stating plainly. Departure from Canada triggers a deemed disposition of most property at fair market value. The resulting gain has to be reported on the final resident return. If your current setup was built on the assumption instead of the rule, that is fixable — but sooner is better than later.

More US Form 1065 Partnership Filing Questions Canadians Ask

The questions Canadians actually search on this topic, answered plainly. Browse every question in the Canadian tax answers directory.

File a T1 return for the year, sending it electronically with CRA-certified software or mailing a paper return. Gather your slips and receipts first and check them against the ones listed in My Account. For the 2025 tax year the filing and payment deadline was 30 April 2026, or 15 June 2026 to file if you or your spouse were self-employed, with payment still due 30 April 2026. CRA online filing for 2025 returns closes 29 January 2027.

There is no single rate. Federal personal income tax for 2026 runs through five brackets: 14%, then 20.5%, 26%, 29% and 33% on the highest band, and your province's brackets stack on top, so your combined marginal rate is the federal rate plus the provincial one. The 2026 federal basic personal amount is $16,452, tapering to $14,829 as net income rises from $181,440 to $258,482. Capital gains and Canadian dividends are taxed on a different basis.

Most refunds on returns filed online arrive in about two weeks; a non-resident return can take up to sixteen weeks. A longer wait usually means the CRA is reviewing a claim, is waiting on a slip or receipt, holds stale direct deposit details, or has applied the refund against another balance such as tax owing, family support or a student loan. Check My Account for the notice of assessment and for any letter asking you for documents.

Childcare services for young children, supplied mainly so a parent can work or study, are exempt from GST/HST, so a daycare does not charge tax on those fees and cannot claim input tax credits on the related costs. The operator's earnings are still taxable income, reported on a T2125 or a T2 depending on the structure. Parents deduct eligible childcare costs on the T1 within the limits on the CRA's child care expenses page.

The consumer bears it; the business collects it. A registered vendor adds GST/HST to taxable sales, holds it in trust and remits it to the CRA, recovering the tax it paid on its own inputs through input tax credits. So businesses in the chain are generally neutral, while the final buyer pays. Some purchasers, including certain Indigenous purchases on reserve, governments and diplomats, have relief, and low-income households receive the quarterly GST/HST credit.

Common non-taxable amounts include lottery and most gambling winnings, gifts and inheritances, life insurance death benefits, TFSA withdrawals and growth, the GST/HST credit and Canada Child Benefit, most personal injury awards, and the gain on a principal residence that fully qualifies. Everything else is taxable unless a rule exempts it, including tips, side and gig income, interest, foreign income and most employer benefits. Report the taxable items even when no slip arrives.

Coffee bought ready to drink from a cafe or restaurant is taxable at the GST/HST rate where you buy it, so 5% GST alone in Alberta, 13% HST in Ontario, 14% in Nova Scotia since 1 April 2025. Coffee beans, ground coffee and instant coffee sold in a grocery store are basic groceries and are zero-rated, so no GST/HST applies. Provincial sales tax follows its own food rules.

Canada has no tax called VAT. The equivalent is GST at 5% for 2025 and 2026, combined with the provincial part as HST in Ontario at 13%, Nova Scotia at 14% since 1 April 2025, and New Brunswick, Newfoundland and Labrador and Prince Edward Island at 15%. Other provinces add a separate provincial sales tax or Quebec's QST. Foreign VAT you paid abroad cannot be recovered through a Canadian GST/HST return.

Sometimes. Under the digital economy rules, a marketplace operator has to collect and remit GST/HST on sales it facilitates for vendors who are not registered themselves, including many non-resident vendors. If you are registered and selling your own goods held in Canada, you generally charge and remit the tax through your own return instead. Read the marketplace's tax reports so the same sale is not reported twice, and reconcile them to your filings.

Manitoba charges 7% retail sales tax (RST) on most goods and many services, and the federal GST of 5% applies as well, so a Manitoba buyer usually pays 12% in total (2026). RST is administered by the province rather than the CRA, so registration and RST returns go through Manitoba Finance while your GST/HST return goes to the CRA. Manitoba also sets its own personal and corporate income tax rates.

Several common receipts are not taxable: most lottery and gambling winnings, gifts and inheritances, TFSA withdrawals and growth, GST/HST credit and Canada child benefit payments, most life insurance proceeds, and the gain on a home that qualifies as your principal residence. Loans, and repayments of your own capital, are not income either. Some amounts are received but fully offset elsewhere on the return. Check the CRA's page on amounts that are not taxed before leaving anything off.

Non-resident income tax is Canadian tax on Canadian-source income earned by someone who is not a resident of Canada for tax purposes. Investment income, rents, pensions and some royalties are normally taxed by withholding at source, with the payer remitting to the CRA. Employment income, business income and gains on Canadian real property are instead reported on a Canadian return. A tax treaty may reduce a withholding rate or remove the Canadian tax altogether.
