US Form 1040 Filing: Our Analysis

Section 216 and 217 elections can substantially reduce non-resident withholding on Canadian rents and pensions when filed on time. We quote us form 1040 filing as one low-cost fixed price — the budget-friendly alternative to hourly billing.

US Form 1040 Filing: Notes From Our Practice

What follows is the working view of an accounting firm who prepares us form 1040 filing week in, week out — the points that decide real files.

The first thing we verify on every engagement: Part XIII withholding of 25 percent applies to dividends, rents, royalties and certain interest paid to non-residents. It is reduced only by the rate the applicable treaty allows. The Canadian payer is liable for tax it failed to withhold, and the amounts are reported on an NR4 information return.

The detail that surprises most owners comes next. The rate charged follows the customer's province, not the seller's: 13% into Ontario, 15% into New Brunswick, Newfoundland and Labrador and PEI, 14% into Nova Scotia (since 1 April 2025), 5% plus provincial tax elsewhere. A seller charging its own province's rate nationally is under-collecting on some sales and over-collecting on others, and owes the difference on the under-collected ones. Ask what a reviewer will want to see, and the answer sits in this rule: A CCPC files its T2 within six months of year-end, with the balance due two months after (three where the small business deduction is claimed). The 9% federal small business rate applies to the first $500,000 of active business income. The filing and payment deadlines differ, and interest runs from the payment date. Filing on time while paying late still costs money.

In practice, this is why us form 1040 filing rewards an accounting firm rather than a generic preparer: each of these points is a judgement call before it is a keystroke. A productive us form 1040 filing engagement starts with paperwork, and the list below covers what to gather.

Whatever the file involves, the terms do not change: fixed fee agreed up front, review together before filing, payment after the service.

Case Study 1

$59,000 Late-Filing Penalty Cancelled On Relief Application — US Retirement Account Holder, Calgary

A dual citizen with a US retirement account in Calgary, Alberta had already been penalised. The issue was winters spent in the United States with the day count kept casually and no residency position documented anywhere. A relief application cancelled $59,000 of that penalty.

A dual citizen with a US retirement account in Calgary, Alberta had already missed one deadline and was about to miss a second. Behind it sat winters spent in the United States with the day count kept casually and no residency position documented anywhere. A penalty of $59,000 was accruing. We split the work into what had to happen before the deadline and what could follow it. Then we aligned the Canadian and US reporting of the same income so the foreign tax credit claim carried support on both returns. The outstanding return was accepted as filed, and the taxpayer relief application cancelled $59,000 of the penalty already assessed on the earlier year.

Case Study 2

Desk-Review Assessment Of $17,500 Vacated — US Rental Owner, Toronto

A desk review assessed a Canadian resident with a US rental property in Toronto, Ontario $17,500. The dispute was over a departure year filed as a normal resident return with no deemed disposition reported. Producing the records vacated the assessment.

A Canadian resident with a US rental property in Toronto, Ontario was carrying $17,500 of penalties and interest. The charges arose from a departure year filed as a normal resident return with no deemed disposition reported. Much of that amount accumulated during a period the CRA itself had delayed. We applied the treaty rate to the dividend withholding, filed the NR4 return, and remitted the shortfall before the CRA assessed the payer for it. We framed the relief application on the specific grounds the CRA guidelines recognise rather than on general hardship. The assessment was vacated. $17,500 came off the account, and the documentation now on file makes the same position straightforward to defend next time.

Case Study 3

Books Rebuilt From Source, $19,000 In Unclaimed Input Tax Found — US LLC Shareholder, Lethbridge

The ledger at a shareholder of a US LLC in Lethbridge, Alberta could not support its own filings. The reason was foreign accounts that had passed the $100,000 T1135 threshold three years earlier. Rebuilding it surfaced $19,000 in unclaimed input tax.

A shareholder of a US LLC in Lethbridge, Alberta could not answer basic questions about its own numbers. Foreign accounts that had passed the $100,000 T1135 threshold three years earlier sat between the bank statements and the ledger. We reported the deemed disposition properly on the departure return and claimed the foreign tax credits that had been left unused. We then documented the process so the work does not depend on any one person remembering how it was done. Records rebuilt and reconciled, $19,000 recovered in input tax credits that the old file could not support, and a documented monthly process now in place.

Case Study 4

$46,000 Cut From The Annual Tax Bill — Non-Resident Landlord, Guelph

A non-resident owning Canadian rental property in Guelph, Ontario was filing correctly and still overpaying. The reason was US tax paid but no foreign tax credit claimed on the Canadian return. Restructuring the position cut $46,000 from the annual bill.

A non-resident owning Canadian rental property in Guelph, Ontario was compliant but paying more than it needed to. The prior year had been filed correctly. It still left US tax paid but no foreign tax credit claimed on the Canadian return on the table. We modelled the current position against the alternatives before changing anything. Then we restructured the US holding so the Canadian and US characterisations aligned, ending the double taxation going forward. The change saved $46,000 in the first year and repeats annually. Nothing about the filings became more aggressive. The position is simply the one the rules already allowed.

Case Study 5

$148,000 Of Working Capital Freed From The Tax Cycle — US Pension Recipient, Kelowna

A Canadian resident receiving US pension income in Kelowna, British Columbia was profitable and permanently short of cash. Behind the gap sat a US LLC taxed as a corporation in Canada, producing double tax on the same income. Restructuring the tax cycle freed $148,000.

A Canadian resident receiving US pension income in Kelowna, British Columbia was profitable on paper and short of cash every month. A US LLC taxed as a corporation in Canada, producing double tax on the same income explained most of the gap. We filed the outstanding T1135 disclosures through the Voluntary Disclosures Program, which eliminated the penalty exposure entirely. We also built a thirteen-week cash view so tax payments stopped competing with payroll for the same dollars. $148,000 was released back into working capital. Remittances have been on time every period since, and the forecast shows the tax outflow before it lands.

Case Study 6

Scaled To 62 Staff With $116,000 Of Working Capital Freed — Inbound Assignee, Barrie

Growth at an inbound transferee on assignment in Barrie, Ontario had outrun the back office. Invoices paid to a non-resident consultant working on site in Canada with no Regulation 105 withholding taken broke first. Headcount reached 62 with $116,000 of cash freed.

An inbound transferee on assignment in Barrie, Ontario was growing fast, with headcount reaching 62 in eighteen months. The back office had not kept up. Invoices paid to a non-resident consultant working on site in Canada with no Regulation 105 withholding taken was the first thing to break. We reconstructed the day count on both sides of the border and documented the residency and treaty position before either revenue authority asked. We built the compliance calendar for the size the business was becoming rather than the size it had been. The business reached 62 staff with no missed remittance and no late filing. $116,000 of working capital was freed in the process.

Straight Answers on US Form 1040 Filing

Direct answers to what Canadian business owners actually ask before hiring an accountant.

How much does US Form 1040 Filing cost in Canada?

US Form 1040 Filing starts at a fixed fee quoted before any work begins. The quote is locked at the outset and does not change mid-engagement, and you pay only after you have reviewed and approved the deliverable. Compare every plan on our transparent pricing page.

What documents do I need for US Form 1040 Filing?

At minimum: prior-year returns and notices of assessment, your bank and credit-card statements for the fiscal period, payroll records if you have employees, and GST/HST filings. We send a checklist tailored to your situation after the free 15-minute call.

How long does US Form 1040 Filing take?

Most engagements are completed within 3 to 5 business days once your documents are complete. Catch-up work covering multiple years takes longer, and we tell you the realistic timeline before you commit rather than after.

What happens if the CRA reviews or audits my filing?

We respond on your behalf at no extra charge for any return we prepared. Every figure we file is supported by documentation retained in your file, which is what turns a CRA review from a crisis into correspondence. See how our CRA audit representation works.

Can you handle late or missed filings?

Yes. Late filing penalties compound at 5% of the balance owing plus 1% per month, so the cost of waiting is real. We prioritise catch-up work and, where eligible, file under the CRA's Voluntary Disclosures Program to reduce penalties.

Do you work with businesses outside major cities?

Yes. We serve clients in every province and territory at the same fixed fees, so your location does not change the price or the service. Browse our coverage across Canada to find your city.

Which industries do you specialise in for US Form 1040 Filing?

We work across construction, healthcare, e-commerce, professional services, restaurants, real estate, transportation, technology and non-profits, each with its own deduction profile and CRA scrutiny patterns. See all industries we serve.

What makes US Form 1040 Filing different from filing it myself?

Software applies the rules you already know about. An experienced tax accountant finds the ones you do not: capital cost allowance timing, the small business deduction threshold, shareholder loan repayment rules, and TOSI exposure on family dividends. The fee is usually smaller than the deductions it surfaces.

What is included in US Form 1040 Filing services?

Our us form 1040 filing services include complete filing, compliance management, and strategic advice customized to Canadian tax laws.

How do I start with US Form 1040 Filing services?

You can start by booking a free 15-minute call. We will review your files, provide a fixed quote, and start working immediately.

How do you price us form 1040 filing for a small business?

You are asking the right question, and it has a real answer. A payment to a non-resident for services performed in Canada is subject to 15 percent withholding under Regulation 105. That applies whether or not the non-resident ends up owing Canadian tax. A waiver has to be applied for before the payment is made, and the payer that withheld nothing is the one assessed. What we add on top of that is the paperwork discipline that makes the answer stand up if anyone ever asks you to prove it.

What goes wrong most often when owners handle us form 1040 filing themselves?

Our answer starts where the legislation starts. Part XIII withholding of 25 percent applies to dividends, rents, royalties and certain interest paid to non-residents. It is reduced only by the rate the applicable treaty allows. The Canadian payer is liable for tax it failed to withhold, and the amounts are reported on an NR4 information return. From there it is a matter of applying it to your year — and that application, not the rule itself, is where a tax preparation specialist earns the fee.

More US Form 1040 Filing Questions Canadians Ask

The questions Canadians actually search on this topic, answered plainly. Browse every question in the Canadian tax answers directory.

A refund is the tax already paid minus the tax actually owed. Add the income tax withheld on your slips to any instalments you paid, work out tax payable on your total income after deductions and credits, and the difference comes back if the first figure is larger. Large refunds usually trace to over-withholding on employment income, RRSP contributions, or credits transferred to you. Run the numbers through the CRA's or a commercial estimator before you file.

The refund is normally released with the assessment itself, so a direct deposit follows soon after the notice appears in My Account, and a cheque takes longer because it travels by post. If nothing arrives, read the notice: the CRA may have applied the refund against an outstanding balance, family support arrears or another government debt, or held it while the return is reviewed or an earlier year remains unfiled. My Account shows the payment date once it is issued.

Your refund is the tax already withheld or paid by instalments minus the tax you actually owe after credits and deductions, so the amount depends entirely on your own numbers - there is no standard figure. Timing is more predictable: the CRA aims to process an online return in about two weeks, and up to 16 weeks for a non-resident return. Direct deposit is faster than a cheque, and amounts owing to government can be offset.

An exemption trust is an American estate planning structure that preserves a deceased spouse's federal estate tax exemption, so there is no direct Canadian equivalent. Canada levies no estate or inheritance tax. Instead, capital property is treated as sold at fair market value on death and the resulting gains are reported on the final return, while a qualifying transfer or spousal trust can defer that tax until the surviving spouse dies. Families with United States ties need advice on both systems.

Forms and the tax software approved for electronic filing are normally released just before filing opens for that year, late in the following February. So 2026 tax year forms are expected early in 2027. The 2025 forms are already out: online filing for the 2025 tax year opened on 23 February 2026 and closes on 29 January 2027. Draft versions sometimes appear on canada.ca sooner, but wait for the final form before you file.

Two separate charges apply. Filing late costs 5% of the balance owing plus 1% for each full month the return is late, to a maximum of 12 months. Paying late costs compound daily interest on the unpaid balance at the CRA's prescribed rate, which is reset every quarter. Interest also runs on the penalty itself. Check the current quarterly rate on the CRA's prescribed interest rates page before estimating what you owe.

Most goods and services carry GST or HST: 5% GST, or 13% HST in Ontario, 15% in New Brunswick, Newfoundland and Labrador and Prince Edward Island, and 14% in Nova Scotia since 1 April 2025. Basic groceries, prescription drugs and medical devices are zero-rated, so no tax applies but the seller still claims input credits. Rent, most health care and tuition are exempt. Provincial sales taxes add a second layer in some provinces.

Canada has no tax called VAT. The equivalent is GST at 5% for 2025 and 2026, combined with the provincial part as HST in Ontario at 13%, Nova Scotia at 14% since 1 April 2025, and New Brunswick, Newfoundland and Labrador and Prince Edward Island at 15%. Other provinces add a separate provincial sales tax or Quebec's QST. Foreign VAT you paid abroad cannot be recovered through a Canadian GST/HST return.

Canada taxes residents on worldwide income. If you are resident for tax purposes you report income from every source, inside and outside the country, and can usually claim a foreign tax credit for tax already paid abroad so the same income is not taxed twice. Non-residents are taxed only on Canadian-source income and on certain Canadian property. Residency is decided on your ties to Canada, not on citizenship or which passport you hold.

EI benefits do not arrive on a T4. Service Canada issues its own benefits slip showing what you were paid and any tax withheld, and posts it in My Service Canada Account as well as CRA My Account, in good time for the filing deadline. EI is taxable, and withholding at source is often lighter than your real rate, so a balance can be owing. Report the slip even if no paper copy reaches you.

No. The temporary GST/HST relief on certain items was a time-limited measure and it has ended. Those sales are taxed under the normal rules again, so groceries follow the usual zero-rated and taxable distinctions and restaurant meals are fully taxable. If a further relief period is ever announced it applies only for the dates set out in the legislation, so check the CRA notice for that period rather than relying on the earlier one.

None of it, if you are a resident of Canada for tax purposes. Residents report worldwide income in Canadian dollars, whatever tax was already paid abroad. Relief comes from the foreign tax credit and from treaty rules, so double taxation is reduced rather than the income being ignored. Non-residents are taxed only on Canadian-source income. Holding foreign property above a reporting threshold also triggers a separate annual information return, which is a disclosure obligation rather than a tax.
