FATCA Form 8938 Assistance: Our Analysis

The T1135 foreign income verification statement applies once specified foreign property passes $100,000 in cost — late-filing penalties start at $25 a day. Our fatca form 8938 assistance engagement is priced as a budget-friendly flat fee, so the cost is known before the work starts.

Practitioner’s Notes on FATCA Form 8938 Assistance

Good fatca form 8938 assistance work is mostly about sequencing: which questions to settle before which. These notes lay out the sequence an income tax specialist follows on FATCA Form 8938 Assistance engagements.

There is no way around the opening fact, so it may as well come first. A CCPC files its T2 within six months of year-end, with the balance due two months after (three where the small business deduction is claimed). The 9% federal small business rate applies to the first $500,000 of active business income. The filing and payment deadlines differ, and interest runs from the payment date. Filing on time while paying late still costs money.

Layer a second constraint on top and the picture sharpens: The T1135 foreign income verification statement is required once specified foreign property exceeds $100,000 in cost. Late-filing penalties start at $25 a day to a maximum of $2,500 per year, before gross-negligence penalties. Then there is the matter of timing, which forgives very little: A US LLC is a flow-through for US purposes but a corporation for Canadian purposes. That mismatch routinely produces double taxation unless the structure is corrected.

You do not need to hold all of this in your head. You need someone who does — and a tax services provider handling fatca form 8938 assistance week after week keeps these rules current so you do not have to. Every fatca form 8938 assistance file rests on documentation, so start by collecting.

No surprises is the operating principle: the fee is agreed and fixed before we start, you review everything before it is filed, and payment comes after the work, not before.

FATCA Form 8938 Assistance Tax & Accounting Case Studies

See how our expert FATCA Form 8938 Assistance tax and accounting services have helped Canadian businesses save money and stay compliant.

Case Study 1

Instalments Rebased, $18,000 Of Cash Returned To The Business — Non-Resident Landlord, Saskatoon

A non-resident owning Canadian rental property in Saskatoon, Saskatchewan was overpaying instalments. The cause was foreign accounts that had passed the $100,000 T1135 threshold three years earlier. Rebasing them returned $18,000 to the business.

A non-resident owning Canadian rental property in Saskatoon, Saskatchewan was paying instalments calculated on a prior year. That year no longer reflected the business. Foreign accounts that had passed the $100,000 T1135 threshold three years earlier was tying up $18,000 of cash. We rebased the instalments on the current-year estimate rather than the prior-year default. Alongside that, we filed the outstanding T1135 disclosures through the Voluntary Disclosures Program, which eliminated the penalty exposure entirely. $18,000 of cash stayed in the business, the penalty cycle ended, and the instalment position is reviewed each quarter against actual results.

Case Study 2

$68,000 Credit Claim Filed And Accepted Without Adjustment — Cross-Border Contractor, Windsor

A contractor working on both sides of the border in Windsor, Ontario had never tested its work against the eligibility rules. The resulting $68,000 claim was accepted without adjustment.

A contractor working on both sides of the border in Windsor, Ontario assumed the credits did not apply to a business its size. A departure year filed as a normal resident return with no deemed disposition reported meant they had applied all along. We identified the qualifying activity and built the documentation to support it. Then we applied the treaty rate to the dividend withholding, filed the NR4 return, and remitted the shortfall before the CRA assessed the payer for it. $68,000 recovered. Because the eligibility analysis is on file, the same claim can be repeated each year with a fraction of the effort.

Case Study 3

Share Sale Restructured, $410,000 Less Tax On Closing — US Retirement Account Holder, Vancouver

Due diligence at a dual citizen with a US retirement account in Vancouver, British Columbia surfaced a single shareholder holding every share, with no room to multiply the exemption. Restructuring the sale saved $410,000 against the original terms.

A dual citizen with a US retirement account in Vancouver, British Columbia was preparing to sell. Due diligence surfaced a single shareholder holding every share, with no room to multiply the exemption. That would have reduced the price or killed the deal outright. We cleaned up the historical file. We filed the section 216 election with the supporting rental statements and recovered the excess withholding as a refund. Then we prepared the due-diligence package the buyer's advisers actually asked for. The deal closed at the agreed price. $410,000 of tax was saved against the structure originally proposed, with no post-closing adjustment.

Case Study 4

$121,000 Late-Filing Penalty Cancelled On Relief Application — Florida Property Owner, London

A family with a Florida vacation property in London, Ontario had already been penalised. The issue was a US LLC taxed as a corporation in Canada, producing double tax on the same income. A relief application cancelled $121,000 of that penalty.

A family with a Florida vacation property in London, Ontario had already missed one deadline and was about to miss a second. Behind it sat a US LLC taxed as a corporation in Canada, producing double tax on the same income. A penalty of $121,000 was accruing. We split the work into what had to happen before the deadline and what could follow it. Then we aligned the Canadian and US reporting of the same income so the foreign tax credit claim carried support on both returns. The outstanding return was accepted as filed, and the taxpayer relief application cancelled $121,000 of the penalty already assessed on the earlier year.

Case Study 5

Growth Handled Without A Missed Filing, $104,000 Freed — Mid-Year Emigrant, Moncton

An emigrant who left Canada mid-year in Moncton, New Brunswick was scaling. The growth exposed US tax paid but no foreign tax credit claimed on the Canadian return. The back office was rebuilt to match, freeing $104,000.

An emigrant who left Canada mid-year in Moncton, New Brunswick was opening in a second province. That meant different filing obligations and a different payroll regime. US tax paid but no foreign tax credit claimed on the Canadian return already sat in the file. We registered the payer for a non-resident withholding account, remitted the Regulation 105 amounts due, and applied for waivers covering the rest of the contract. We then put monthly reporting in place. That let the owner see the cash effect of growth while there was still time to act on it. Growth was absorbed without a compliance failure. $104,000 of cash was released, and the monthly reporting now flags a problem while it is still small.

Case Study 6

$87,000 Reassessment Reduced To Nil On Review — US Pension Recipient, Mississauga

An $87,000 reassessment was proposed against a Canadian resident receiving US pension income in Mississauga, Ontario. It followed winters spent in the United States with the day count kept casually and no residency position documented anywhere. The documented response reduced it to nil.

A review notice arrived at a Canadian resident receiving US pension income in Mississauga, Ontario, covering FATCA form 8938 assistance for two tax years. The auditor's working position was an adjustment of $87,000. It was driven by winters spent in the United States with the day count kept casually and no residency position documented anywhere. Rather than negotiate, we rebuilt the record. We restructured the US holding so the Canadian and US characterisations aligned, ending the double taxation going forward. We then submitted a point-by-point response that answered each proposed adjustment with the document behind it. The auditor accepted the documented position and closed the review without adjustment, protecting $87,000 and leaving the prior filings undisturbed.

Before You Call: FATCA Form 8938 Assistance FAQs

Direct answers to what Canadian business owners actually ask before hiring an accountant.

How much does FATCA Form 8938 Assistance cost in Canada?

FATCA Form 8938 Assistance starts at a fixed fee quoted before any work begins. The quote is locked at the outset and does not change mid-engagement, and you pay only after you have reviewed and approved the deliverable. Compare every plan on our transparent pricing page.

What documents do I need for FATCA Form 8938 Assistance?

At minimum: prior-year returns and notices of assessment, your bank and credit-card statements for the fiscal period, payroll records if you have employees, and GST/HST filings. We send a checklist tailored to your situation after the free 15-minute call.

How long does FATCA Form 8938 Assistance take?

Most engagements are completed within 3 to 5 business days once your documents are complete. Catch-up work covering multiple years takes longer, and we tell you the realistic timeline before you commit rather than after.

What happens if the CRA reviews or audits my filing?

We respond on your behalf at no extra charge for any return we prepared. Every figure we file is supported by documentation retained in your file, which is what turns a CRA review from a crisis into correspondence. See how our CRA audit representation works.

Can you handle late or missed filings?

Yes. Late filing penalties compound at 5% of the balance owing plus 1% per month, so the cost of waiting is real. We prioritise catch-up work and, where eligible, file under the CRA's Voluntary Disclosures Program to reduce penalties.

Do you work with businesses outside major cities?

Yes. We serve clients in every province and territory at the same fixed fees, so your location does not change the price or the service. Browse our coverage across Canada to find your city.

Which industries do you specialise in for FATCA Form 8938 Assistance?

We work across construction, healthcare, e-commerce, professional services, restaurants, real estate, transportation, technology and non-profits, each with its own deduction profile and CRA scrutiny patterns. See all industries we serve.

What makes FATCA Form 8938 Assistance different from filing it myself?

Software applies the rules you already know about. An experienced tax accountant finds the ones you do not: capital cost allowance timing, the small business deduction threshold, shareholder loan repayment rules, and TOSI exposure on family dividends. The fee is usually smaller than the deductions it surfaces.

What is included in FATCA Form 8938 Assistance services?

Our fatca form 8938 assistance services include complete filing, compliance management, and strategic advice customized to Canadian tax laws.

How do I start with FATCA Form 8938 Assistance services?

You can start by booking a free 15-minute call. We will review your files, provide a fixed quote, and start working immediately.

How do I know if my business actually needs fatca form 8938 assistance?

In our files, this is the deciding factor: The T1135 foreign income verification statement is required once specified foreign property exceeds $100,000 in cost. Late-filing penalties start at $25 a day to a maximum of $2,500 per year, before gross-negligence penalties. A tax specialist applies it to your numbers before submission.

What will you need from me to get fatca form 8938 assistance started?

The honest answer comes down to one rule. That is the part we verify before anything is filed.

What Canadians Search About FATCA Form 8938 Assistance

The questions Canadians actually search on this topic, answered plainly. Browse every question in the Canadian tax answers directory.

For the 2025 tax year the filing and payment deadline is 30 April 2026. If you or your spouse carried on a business, the return itself is due 15 June 2026, but any balance owing is still due 30 April 2026. Interest runs on unpaid amounts after the payment deadline, and a late-filed return with a balance owing also attracts a late-filing penalty. Filing on time keeps benefit and credit payments flowing.

CRA online filing for 2025 returns opened on 23 February 2026 and stays open until 29 January 2027. You can prepare a return before the service opens, but it cannot be transmitted, and slips such as T4s and T5s often arrive only in late February. Filing early makes sense if you expect a refund. If you expect a balance owing, you can still file early and pay by 30 April 2026.

Yes. Most people file electronically through NETFILE using CRA-certified software, which submits the return directly and confirms receipt immediately. Filing online is also what makes a fast refund possible: for 2025 returns filed in 2026 the CRA service standard is about two weeks online, against a considerably longer standard for a paper return, and registering direct deposit removes the cheque step. CRA online filing for 2025 returns opened 23 February 2026 and closes 29 January 2027.

Interest compounds daily on an unpaid balance from the day after the payment due date, at a prescribed rate the CRA sets each quarter and publishes on canada.ca, so check the current quarter rather than an older figure. A separate late-filing penalty applies if the return itself is late, calculated on the balance owing and growing for each month it stays outstanding. Paying part of the balance reduces the interest that keeps accruing.

An exemption trust is an American estate planning structure that preserves a deceased spouse's federal estate tax exemption, so there is no direct Canadian equivalent. Canada levies no estate or inheritance tax. Instead, capital property is treated as sold at fair market value on death and the resulting gains are reported on the final return, while a qualifying transfer or spousal trust can defer that tax until the surviving spouse dies. Families with United States ties need advice on both systems.

In your bank's bill payment screen, search the payee list for the Canada Revenue Agency and pick the entry that matches the debt: personal income tax owing, personal instalments, GST/HST, corporation tax, or payroll source deductions. The account number is your social insurance number for personal tax, or your business number with the correct program identifier for a business account. Paying the wrong payee parks the money in the wrong account while interest runs, so ask the CRA to transfer it.

A small business corporation is a Canadian-controlled private corporation that uses substantially all of its assets in an active business carried on mainly in Canada. The label matters because it opens access to the small business deduction, which for 2026 applies the 9% federal rate to the first $500,000 of active business income, and to the lifetime capital gains exemption on a share sale. Holding companies and passive investment corporations usually fail the asset test.

No. The federal adoption expense credit is non-refundable, so it reduces tax you owe and cannot by itself create a refund. If your tax payable is already nil, the credit produces nothing. Eligible expenses are claimed in the tax year the adoption is finalised, and two adoptive parents can split one claim up to the annual maximum. Some provinces offer a separate credit of their own. The CRA's adoption expenses page lists what qualifies and the current limit.

Not alone. A municipal council sets the property tax rate when it votes the annual budget and levy, and the mayor holds one vote, though a few provinces give mayors added budget powers that council can still override. Your bill is the assessed value of the property multiplied by that rate, plus an education portion the province sets. Assessments come from a provincial assessment body, not from the mayor.

Rent paid is not deductible on the federal return. Relief comes instead through provincial credits claimed on the provincial form filed with your T1, such as Ontario's energy and property tax credit, Manitoba's renters credit and Quebec's solidarity tax credit, each with its own residency and income tests. Rent is deductible only as a business or employment cost: the work-space-in-the-home share on a T2125, or with an employer-signed form where an employee is required to work from home.

Municipal property tax is billed by your city, not the CRA, and most Canadian municipalities let you spread it over instalments or a monthly pre-authorized plan instead of paying two lump sums. Arrangements are made with the city's tax office, and arrears usually carry monthly interest set by by-law. Property tax on your own home is not deductible; on a rental or a qualifying home office it can be claimed.

A refund is not taxable. It returns tax you already overpaid through withholding or instalments, so it never goes back on a return as income. Interest the CRA pays on a delayed refund is different: that interest is taxable and belongs on the return for the year you receive it. A refund also has no effect on the credits or benefits you claim.
